<br />Motion: I move the Town vote to approve Article 1 as printed in the warrant, with the <br />exception of the phrase “or take any other action relating thereto.” <br /> <br />Motion passes 303 to 10 at 7:17PM <br /> <br /> <br />Article 2 <br /> <br />To see if the Town of Mashpee will vote to accept the provisions of Chapter 40, Section 13E of the <br />Massachusetts General Laws to establish a Special Education Reserve Fund, consistent with the <br />vote of the Mashpee School Committee, to be utilized upon adoption by the Town and in subsequent <br />fiscal years, for the general purposes of funding, without further appropriation, unanticipated or <br />unbudgeted costs of special education and recovery high school programs, out-of-district tuition or <br />transportation, all as provided by law; provided, however, that such funds shall be expended only <br />with the approval of a majority vote of the School Committee and a majority vote of the Select <br />Board; and provided that the balance in such reserve fund shall not exceed two (2) percent of the <br />annual net school spending established for the school district; or take any other action relating <br />thereto. <br /> Submitted by the Mashpee School Committee <br /> <br />Explanation: Due to the volatility in funding required year-to-year for providing special education <br />services, the Special Education Reserve Fund (“Reserve Fund”) was created by the Municipal <br />Moderation Act (Chapter 218 of the Acts of 2016) and the Reserve Fund is governed by MGL <br />Chapter 40A, Section 13E. Any school district which accepts this section, by a majority vote of the <br />School Committee and a majority vote of the legislative body at Town Meeting, may establish and <br />the School Committee may appropriate or transfer money to a Reserve Fund to be utilized upon <br />adoption and in upcoming fiscal years, to pay, without further appropriation, for unanticipated or <br />unbudgeted costs of special education and recovery high school programs, out-of-district tuition <br />and/or transportation. Funds shall only be distributed from the Reserve Fund after a majority vote <br />of the School Committee and a majority vote of the Select Board. The Town Treasurer may invest <br />the monies in the Reserve Fund in the manner authorized in Section 54 of MGL Chapter 44 and any <br />interest earned thereon shall be credited to and become part of the Reserve Fund. The Reserve Fund <br />balance shall not exceed two (2) percent of the annual net spending of the Mashpee School district, <br />which would be equivalent to approximately $522,286 for FY 2026. The Reserve Fund will be <br />funded through the allocation of unused school funds at the end of the fiscal year in an amount to <br />be determined by the School Committee. Any balance in the Reserve Fund can be carried forward <br />to future fiscal years and remains in the Reserve Fund until needed and expended. <br /> <br />The Select Board recommends approval of Article 2 by a vote of 5-0 <br />The Finance Committee recommends approval of Article 2 by a vote of 6-0 <br /> <br />Motion made by Select Board Member Cotton <br /> <br />Motion: I move the Town vote to approve Article 2 as printed in the warrant, with the <br />exception of the phrase “or take any other action relating thereto.” <br /> <br />Motion passes 313 to 30 at 7:18PM <br /> <br /> <br /> <br /> <br />
