with the Trust and otherwise to contract with the Trust and the Department of Environmental <br />Protection with respect to such loan and for any federal or state aid available for the project or for <br />the financing thereof; and that the Select Board is authorized to enter into a project regulatory <br />agreement with the Department of Environmental Protection, to expend all funds available for the <br />project, to acquire, by purchase, gift, and/or eminent domain, any other land and/or easements <br />necessary or appropriate for the purpose of undertaking the project, and to take any other action <br />necessary or convenient to carry out the project, provided, however, that any borrowing authorized <br />hereunder shall be expressly subject to and contingent upon approval by the voters of the Town of <br />a ballot question to exclude from the limitations of Proposition 2 1/2, so-called, G.L. c.59, §21C, <br />the amounts required to pay the principal and interest on any bonds, notes or certificates of <br />indebtedness issued hereunder; or take any other action relating thereto. <br /> <br /> Submitted by the Select Board <br /> <br />SEE VISUAL AID IN APPENDIX A <br /> <br />Explanation: This Article would provide funding to construct a remote wastewater collection, <br />treatment and recharge facility north of Mashpee Wakeby Ponds to remove nitrogen from the <br />Popponesset watershed improving water quality in Popponesset Bay. Additionally, this facility <br />will remove phosphorus to help the health of the ponds. The Town requested, and MassDEP <br />approved, inclusion of this project in Mass DEP's 2025 Intended Use Plan (IUP) for a zero-interest <br />State Revolving Fund (SRF) loan. Article 4 requires a 2/3 vote. <br /> <br />The Select Board recommends approval of Article 4 by a vote of 5-0 <br />The Finance Committee recommends approval of Article 4 by a vote of 5-0 <br /> <br />Motion made by Select Board Member Richardson <br /> <br />Motion: I move the Town vote to authorize the Treasurer, upon the approval of the Select <br />Board, to borrow the sum of $25,900,000 pursuant to G.L. c.44, §§7 or 8 or any other enabling <br />authority, and issue bonds and notes of the Town therefor, and to appropriate said sum for <br />purposes of paying the costs of construction of a remote collection, recharge and <br />treatment facility and the acquisition of land/easements, including all other costs incidental <br />and related thereto, all as described in the article and as recommended by the Capital <br />Improvement Program Committee; that the Treasurer with the approval of the Select Board <br />is authorized to borrow all or a portion of such amount from the Massachusetts Clean Water <br />Trust established pursuant to Chapter 29C and in connection therewith to enter into a <br />financing agreement with the Trust and otherwise to contract with the Trust and the <br />Department of Environmental Protection with respect to such loan and for any federal or state <br />aid available for the project or for the financing thereof; and that the Select Board is <br />authorized to enter into a project regulatory agreement with the Department of <br />Environmental Protection, to expend all funds available for the project, to acquire, by <br />purchase, gift, and/or eminent domain, land and/or easements necessary or appropriate for <br />the purpose of undertaking the project, and to take any other action necessary or convenient <br />to carry out the project; provided, however, that this vote shall be expressly subject to and <br />contingent upon approval by the voters of the Town of a ballot question to exclude from the <br />limitations of Proposition 2 1/2, so-called, G.L. c.59, §21C, the amounts required to pay the <br />principal and interest on any bonds, notes or certificates of indebtedness issued hereunder. <br /> <br /> <br />Motion passes 365 to 93 at 8:24PM <br /> <br /> <br />
