MEETING MINUTES <br /> ZONING BOARD OF APPEALS <br /> WEDNESDAY, OCTOBER 8, 2025 <br /> The Conservation Commission issued an Order of Conditions at their last meeting, and approved <br /> the project. <br /> Mr. Morris had no issues with this project. <br /> There were no comments from the audience. There were no more comments from the Board. <br /> Mr. Bonvie asked for motion to close the public hearing. Mr. Furbush, so moved. Mr. Caggiano <br /> second. All were in favor. <br /> Mr. Goldstein made a motion that the Board approve 9 Tuspaquin with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Site Plan—Prepared for: Mario and Gina Recupero,Project: 9 Tuspaquin Rd.,Date: March <br /> 25, 2025, Revised: 9/18/25 Add drywells, 10/3/2025: Add additional lot coverage notes. <br /> Prepared by: Cape & Islands Engineering. Stamped and signed by: John McElwee, <br /> Professional Land Surveyor, No.: 33602. <br /> 3. Building Plans — Prepared for Recupero Residence, 9 Tuspaquin Road, Proposed Living <br /> Area, Proposed Front, Rear, Left, and Right Elevation, Prepared by: JB Designs, Date: <br /> 3/12/25. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Conservation Department and Board of Health. <br /> 5. Any changes to the plans will require the applicant to return to this Board. <br /> 6. The Board finds under §174-17 that the proposed project is not substantially more <br /> detrimental than the pre-existing,nonconforming structure or use to either the Town or the <br /> neighborhood. <br /> 2 <br />
