5 <br /> <br /> <br />Community Preservation Committee <br />Minutes-Executive Session <br />October 17, 2024 <br /> <br />Present: Arden Russell, Brian Hyde, Mary Waygan, Lynne Barbee, <br /> Michaela Wyman-Colombo, Sandi Godfrey, Judy MacDougall, Ted Schmuhl <br /> <br />Absent: Richard Klein <br /> <br /> Meeting Called to Order by Chairman Russell at 7:21 p.m. <br /> Mashpee Town Hall, Waquoit Meeting Room <br />EXECUTIVE SESSION <br />Discussion regarding Gooseberry Island: <br />A brief discussion followed with respect to the potential acquisition of Gooseberry Island. <br />The Community Preservation Committee was in receipt of an appraisal of the property as <br />referenced which brought forth; Value as if Unbuildable and Value as if Buildable. With respect <br />to this regard, there has been no definitive answer. It is therefore necessary for the applicant to <br />provide evidence if the lot is buildable or unbuildable. It was agreed the appraisal as provided by <br />the Appraisal Company of Cape Cod, Inc. dated October 8, 2024 would be released to the <br />applicant by the CPC Chair. The CPC was noted to be legally bound to the maximum value of <br />the appraisal if the land is determined as buildable. <br />Motion made by Ms. Waygan to authorize the CPC Chair to communicate to the applicant, <br />the CPC cannot act on the application as filed. If the lot is deemed buildable, the CPC <br />would re-open discussions for this action. Motion seconded by Ms. Barbee. <br />VOTE: 8-0. Unanimous. <br />Roll Call Vote: <br />Ms. Russell, yes Mr. Hyde, yes Ms. Waygan, yes Ms. Barbee, yes <br />Mrs. Wyman-Colombo, yes Ms. Godfrey, yes Mrs. MacDougall, yes <br />Mr. Schmuhl, yes Opposed, none <br /> <br />Motion made by Mrs. Wyman-Colombo to authorize the CPC Chair to further <br />communicate with the applicant regarding the CPC’s inability to act on the application as <br />submitted, and based on the appraisal, the CPC cannot expend over the value of the <br />appraisal if the lot is buildable. The CPC Chair was directed to provide a copy of the <br />appraisal relative to Gooseberry Island to the applicant. <br />Motion seconded by Mrs. MacDougall. <br />VOTE: 8-0.
