MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY, 26, 2025 <br /> Chairman Bonvie asked for comments from the Building Commissioner. <br /> Mr. Morris said the lot is unbuildable. He spoke to the neighbors and they told <br /> him that the dock was built by the Army Corp of Engineers for military access, <br /> and it predates zoning. The garage requires a Special Permit because it's over <br /> 200 sq. ft. and requires to be building code compliant. <br /> The Board questioned if the structure requires a variance because it is totally <br /> within the flood zone. Mr. Morris said it only requires a Special Permit because <br /> the structure will not be used for habitable space. There's no mechanicals and <br /> no plumbing allowed. Mr. Morris said for the record that the abutting properties <br /> are the same owner, and the garage will serve for their recreational storage <br /> purposes only. <br /> Mr. Reidy asked what if there are future requests to change the use of the lot. <br /> Mr. Bonvie asked why weren't the lots combined so the garage could become and <br /> accessory use. <br /> Mr. Bonvie explained to the Attorney Douglas that the garage requires 50 ft. of <br /> relief because it is totally within the flood zone. The Attorney is also seeking relief <br /> that the garage is considered the primary structure. Mr. Bonvie stated that will <br /> be a question for the Building Commissioner. <br /> Mr. Morris said for the record that he is fine with the project to be the primary <br /> structure. <br /> The Chair asked for audience comments. <br /> Ms. Burman, an abutter at 11 Shoestring Bay Road asked how many trees will <br /> be removed from the proposed lot. Attorney Douglas stated he understands there <br /> are no trees being removed on this lot for this garage. <br /> Mr. Blaisdell mentioned that there is a tree Town bylaw that is a condition and <br /> is part of the motion. <br /> Mr. Bonvie said that the applicant stated for the record that there are no trees <br /> being removed. <br /> Ms. Burman mentioned that she has concerns with the area and that the gate <br /> to the property is always open. She knows that there are contractors'involvement <br /> but is concerned for the neighborhood. The Board asked Ms. Burman to speak <br /> with the Building Commissioner regarding the gate. <br />
