MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY, 26, 2025 <br /> Attorney Kirrane requested a withdrawal without prejudice. Mr. Bonvie asked for <br /> a motion to accept Attorney Kirrane's withdrawal without prejudice. Mr. <br /> Blaisdell, so moved. Mr. Milbury, second. All were in favor. <br /> 425 Monomoscoy Road: Owners, Mark H. and Lisa White request a Special <br /> Permit under §174-17.1, and §174-33 of the Zoning Bylaws to raze and replace <br /> a pre-existing, nonconforming single-family structure on property located in an <br /> R-3 Zoning District, Map 124, Parcel 55, Mashpee, MA. <br /> Attorney Christopher Kirrane represented the Owners, Mark and Lisa White who <br /> were also present seeking a Special Permit to raze and replace a single-family <br /> dwelling located in the R-3 Zoning District. <br /> The lot has a few pre-existing, nonconforming conditions; the existing dwelling <br /> is completely located within the flood zone, and consists of 20,569 sq. ft. of land. <br /> The northerly side yard setback is currently at 12.4 ft. where 15 ft. is required. <br /> The lot coverage will increase from 14.5% to 18% (total upland area) and is under <br /> the 20% requirement. The existing side yard setback non-conformity will be <br /> eliminated. <br /> The new construction will not create any new nonconformities and will not <br /> require any variance relief. The Board can find that the redevelopment will not <br /> result in a condition that is substantially more detrimental than what currently <br /> exists in the neighborhood as follows: <br /> 1. The new construction will be building code compliant. <br /> 2. The new construction will be flood zone compliant. <br /> 3. A new denitrification septic system is proposed. <br /> 4. Drywells are being installed to collect storm water runoff. <br /> 5. The northerly side yard setback nonconformity is being eliminated. <br /> 6. The project is consistent with other development in the area. <br /> Mr. Reidy read the Board of Health comments into the record; "Septic is <br /> Designed for 4 bedroom. Floor plans submitted 2-24-25 show cased opening on <br /> "office" house has 4 bedrooms." <br />
