(8.7 /9.4 / 10.23) (legacy Reg 25) 43- <br /> 3356 <br /> Other Team Members: <br /> • Attorney Adam Brodsky (environmental/land use counsel) <br /> • Andrew Garelli, RLA (Yarmouth Port Design Group) <br /> • Ekaterina Labovitch (Architect Associates) <br /> Project Status, Deliverables, and Abutter Concerns <br /> Attorney Brodsky opened by noting that both property owners and the project engineer, Mr. Roland, were <br /> unable to attend,but the landscape architect and building architect were present to address design details. <br /> He summarized the items delivered since the last hearing: <br /> • A recorded Title V nitrogen loading restriction and easement has been provided for both this house <br /> project and the related septic approval so that the Commission has the formal nitrogen-credit instrument <br /> on file. <br /> • A revised waiver letter, dated November 6, 2025, now explicitly references the Commission's <br /> Regulation 12 performance standards, as requested at the prior hearing. <br /> Attorney Brodsky then addressed the concerns previously raised by the abutters at 9 Deans Hollow Road(the <br /> Thurston's). Their earlier written and verbal comments focused on: <br /> • The location and design of the proposed retaining wall on the applicants' property. <br /> • Potential impacts on the Thurston's' existing retaining wall. <br /> • The placement of yard drains and a dry well near the shared property line. <br /> He explained that he has met with the Thurston's' multiple times since the last hearing. Those discussions led <br /> to several minor plan revisions, now shown on: <br /> • A revised proposed site and septic plan (Cape and Islands Engineering, dated November 4, 2025). <br /> • A revised landscape plan (Yarmouth Port Design, also dated November 4, 2025). <br /> • A revised foundation plan (Architect Associates, dated November 4, 2025). <br /> Key changes include: <br /> • The modular block retaining wall on the applicants' side will remain where shown, approximately four <br /> feet from the Thurston's' existing wall. This spacing: <br /> o Allow each property owner to maintain their own wall. <br /> o Avoid pushing additional fill further into the floodplain. <br /> o Preserves space for mitigation plantings between and around the walls. <br /> • Yard drains on the side nearest the Thurston's have been removed, and the dry well has been shifted to <br /> approximately nine feet from the shared property line, further reducing any perceived risk that <br /> infiltrated stormwater could undermine the abutters' wall. <br /> • Detailed information on the modular wall system (construction section, drainage detail) is now <br /> incorporated on the landscape plan and was provided to the Thurston's for review in advance of the <br /> hearing. <br /> 11 <br />
