Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> not circulated publicly until they come before the full Commission as part of the normal hearing and adoption <br /> process. <br /> After discussion, the Commission reached consensus to maintain the current working-group structure rather <br /> than convert it into a formal subcommittee. Members agreed that it remains an advisory, consensus-based <br /> body, and that transparency will continue to be provided through public circulation of draft regulations and <br /> bylaw changes when they come before the full Commission. The group's composition was updated to <br /> Commissioners Colombo and Godfrey, along with Mr. McManus and Mr. Kent, with Ms. Thornbrugh <br /> designated as an alternate commissioner who may participate when scheduling and notice allow. The working <br /> group will continue to meet via Zoom on a flexible schedule. <br /> • Submittal Requirements Update <br /> Submittal Requirements Checklist—Discussion and Revisions <br /> The Commission reviewed proposed updates to the Notice of Intent(NOI) submittal requirements checklist <br /> prepared by staff. Mr. McManus explained that the draft language at the top of the form currently states that <br /> any application missing required information "will not be placed on the hearing agenda for the upcoming <br /> meeting." He agreed with the intent to discourage incomplete filings but noted the need to remain compliant <br /> with the 21-day statutory requirement under 310 CMR 10.05(5), which obligates the Commission to hold a <br /> public hearing within 21 days of receipt of a permit application. Town Counsel has advised that "receipt" <br /> occurs once the application arrives in the building (for example, when it reaches the mailroom), even if it has <br /> not yet been opened or delivered to the Conservation office. The Agent distinguished MassDEP's "minimum <br /> submittal requirements" (i.e., complete DEP application form, required boxes checked, and basic elements) <br /> from the additional materials the Town requires (plans of record, narratives, GIS plans, etc.). He recommended <br /> that the checklist be revised to avoid language suggesting that an application might be withheld from an agenda <br /> altogether. Instead, the Commission agreed that incomplete applications will still be scheduled within the <br /> statutory deadline but may be continued at the hearing if key materials are missing. Language will be adjusted <br /> to state that applications lacking required information are subject to continuance and project delays until all <br /> materials are provided. <br /> Commissioners also reviewed language specifying that engineered plans must be submitted at least five <br /> business days prior to a scheduled hearing. It was suggested that moving that timing requirement to the top of <br /> the checklist and broadening it so that it applies to all required documents, not only to just engineered plans. <br /> Commissioners agreed that having a full package at least five business days in advance is important to allow <br /> for meaningful review, site visits, and preparation; receiving critical documents on the day of or just before a <br /> hearing has repeatedly hindered the Commission's ability to make well-informed decisions. The checklist will <br /> be revised to state that all required documents must be submitted at least five business days before the <br /> scheduled hearing date. <br /> The Commission next considered the item requiring proof of filing with the Zoning Board of Appeals. A <br /> Commissioner asked whether the same standard should apply to other relevant boards and departments, such as <br /> the Board of Health or Planning Board. Staff recalled that earlier bylaw language required that permits be <br /> "obtained" from other boards before Conservation review, which proved unworkable when multiple boards <br /> wanted to hear applications in a certain order. That language was later revised to "applied for"to reduce <br /> conflicts. The Commission agreed that the checklist should reflect this approach and require proof that <br /> applicants have filed with other relevant boards and commissions with overlapping jurisdiction, not just the <br /> Zoning Board.
