(Representative: Homestead Consulting Engineers) 43- <br /> 3381 <br /> Mr. McManus provided additional background explaining why the application for 30 Captains Row is not <br /> yet ready for substantive review. The applicant's survey depicted 75-foot and 150-foot setback lines <br /> measured from a cranberry bog, which prompted jurisdictional questions. Staff noted that the bog appears to <br /> be actively managed, and if confirmed, it would be agriculturally exempt and therefore not regulated as a <br /> wetland under the Wetlands Protection Act. <br /> However, Mr. McManus explained that the Quaker Run River system, which includes a bog ditch along <br /> the outer portion of the same bog, is a designated riverfront area. This riverfront resource was not correctly <br /> identified or delineated on the submitted survey. The surveyor has been advised of this issue and understands <br /> the need to revise the plans. <br /> Additional plan deficiencies were identified, including the absence of a clearly defined work limit and <br /> failure to show inner and outer riparian zones associated with riverfront area. While the inland bank was <br /> shown correctly, staff noted that whether riverfront jurisdiction actually extends onto the property remains <br /> uncertain. If the 200-foot riverfront area does not cross onto the parcel, both riverfront and inland bank <br /> jurisdiction may ultimately be inapplicable,potentially placing the project outside Conservation Commission <br /> jurisdiction. <br /> It was emphasized that further review will depend on updated survey information and proper delineation <br /> of the brook/riverfront, and that the application will return once these issues are clarified. <br /> MOTION: To continue to January 8, 2026, for 49 The Heights to allow for <br /> more time for delineation of riverfront buffer. <br /> Motion by: Sandi Godfrey Seconded by: Richard Sahl <br /> Vote: Motion passed by unanimous vote. <br /> (Sarah Thornbrugh, Paul Colombo, Sandi Godfrey, Richard Sahl, Seana Pitt) <br /> 8 <br />
