Jackmauh Trustee. Proposed replacement of existing <br /> retaining wall, walkway, driveway, and steps. (Representative: Outerland) <br /> The applicant requested a continuance before substantive review. Staff explained that the request for continuance <br /> was necessary because a portion of the retaining wall proposed for reconstruction extends into the road shoulder, <br /> and Monomoscoy Road is a Town-owned roadway. As a result, part of the proposed work would occur outside <br /> the subject property boundary. <br /> The applicant was advised that the Conservation Commission cannot review or approve work on land not owned <br /> by the applicant without documented authorization from the landowner. In this case, that authorization would <br /> need to come from the Town of Mashpee, likely through the Department of Public Works (DPW). Staff noted that <br /> this issue was initially identified during discussions with the Zoning Board of Appeals, prompting the applicant to <br /> pause the Conservation review. The applicant's consultant indicated they will coordinate with DPW and the <br /> appropriate Town departments to clarify ownership, obtain any required permissions, and resolve the roadway <br /> encroachment issue before returning to the Commission. <br /> No substantive review of the environmental aspects of the project occurred at this hearing. The applicant's representative, Josh <br /> Green of Homestead Consulting Engineers,presented revisions made in response to concerns raised at the prior <br /> hearings. <br /> --------------------------------------------------- <br /> Revised Pool Layout and Inland Bank Considerations <br /> Mr. Green explained that an alternative pool orientation was evaluated, including rotating the pool farther from <br /> the deck to address safety concerns. However, that configuration resulted in the pool structure moving closer to <br /> the inland bank, increasing the potential impact to the bank due to excavation.
