MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES JANUARY 14, 2026 The Conservation Department comments dated January 9, 2026, were read into the record; "Resource Areas: Buffer zone to Coastal Bank & buffer zone to Salt Marsh. Administrative Approval was issued due to replacement of sauna tubes with diamond piles, existing sauna tubes will remain, and work will be conducted by hand only." The Board of Health comments dated January 12, 2026 were read into the record: "Deck work only". There were no Board questions. There were no comments from Mr. Morris. Mr. Bonvie asked for a motion to close the public hearing. Mr. Reidy so moved. Mr. Furbush second. All were in favor. Mr. Bonvie asked for a motion in reference to the application. Mr. Reidy made a motion that the Board issue a Written Finding for 110 Summersea Road with the following conditions: 1. The Board has determined that the applicant meets all the conditions of a Written Finding under Mass General Law 40A Section 6. 2. Site Plan — Existing & Proposed Conditions Plan, prepared for Steven Damalas, Date: Oct. 20, 2025, Scale: 1" = 20', Rev: 10/23/25, 1/8/26. Prepared by: Richard Hood, PLS, No.: 3 503 1. 3. Drawings: Exterior Finishes, North and South Elevation, Diamond Pier Footing. 4. Conditioned on all Town Department comments read into the record including but not limited to the Conservation Department and Board of Health. 5. Any changes to the plans will require the applicant to return to this Board. 6. The Board finds under §174-17 and §174-33 that the proposed deck project as submitted is not substantially more detrimental than the pre-existing, nonconforming structure to either the Town or the neighborhood.
