MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 14, 2026 <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Conservation Department and Board of Health. <br /> 5. Any changes to the plans will require the applicant to return to this Board. <br /> 6. The Board finds under §174-17 and §174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood. <br /> Ms. Sangeleer, second, yes, <br /> Mr. Furbush, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Bonvie, yes, <br /> Mr. Morizio, yes. <br /> All were in favor to issue a Written Finding. <br /> 252 Shore Drive: Owner, Concert New Seabury, LLC requests a Written Finding under §174-17 <br /> and §174-33 of the Zoning Bylaws to allow for replacement and reconstruction of an existing <br /> outdoor tent that is situated on top of an elevated platform, on property located in an R-3 Zoning <br /> District. Property is located with the 1964 New Seabury Special Permit, Map 123, Parcels 165, <br /> 166, and 192, Mashpee, MA. (Continued from 12110125 hearings at the request of the Board). <br /> Sitting on this hearing are the four regular Board members, and Associate Member, Mr. Reidy. <br /> Brian Yergatian. with BSC Group represented the applicant. Also present was Megan Brady, <br /> Architect with S3 Design. <br /> At the last hearing in December, there were a couple of items that needed to be addressed. The <br /> zoning dimensional table that was in the application required to be documented on the plan. There <br /> were some questions about the building design noting the hatching area. The third and final item <br /> was the elevation of the tent, and a rendering design view from the ocean. <br /> Ms. Brady mentioned that the hatching area on the rear is being removed but there will be new <br /> operable windows so that the bar will still serve the wedding venue. The area between the bar and <br /> the ocean will have tables. The building itself will be removed, and a new deck will replace the <br /> existing bar. The tent will now cover that portion which was previously a building. <br /> The tent will be level with the rest of the area as it currently exists through the breezeway between <br /> the restaurant side and the bar at the main entrance level. Everything will be lifted to that level. <br /> The actual height of the tent is 26 feet above the deck height. <br /> 5 <br />
