MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 14, 2026 <br /> 18 Starboard Lane: Owner, Shallow Shores, LLC requests a Written Finding under §174-17 and <br /> §174-33 of the Zoning Bylaws to reconstruct an existing deck in the same footprint and add an <br /> enclosed porch over the existing deck on property located in the R3 and Popponesset Overlay <br /> Districts, Map 118, Parcel 12, Mashpee, MA. (Continued from 11112125 hearings at the request <br /> of the Attorney). <br /> Sitting on this hearing are the four regular Board members and Associate Member, Michael <br /> Morizio. <br /> Attorney Christopher Kirrane represented the applicant requesting to replace an existing deck and <br /> enclose it within the same footprint. The hearing was continued by the Board to confirm the <br /> comments submitted by the Health Agent and allow the applicant to revise the drawing plan to <br /> eliminate one bedroom. The project was approved by the Conservation Commission. <br /> Mr. Morizio read the Conservation Department comments dated January 9, 2026, into the record: <br /> "Resource Areas: LSCSF & buffer zone to Coastal Bank. RDA application received a negative <br /> determination with a 3:1 vote from the Commission with the condition of installation of one drywell <br /> to collect roof runoff. Concerns about the impacts from construction were overcome since part of <br /> the property is not within wetland jurisdiction and work in jurisdiction is being mitigated with <br /> native plantings along Wading Place Road where currently none exists. " <br /> Board of Health comments dated January 12, 2026, were read into the record; "House to remain <br /> three bedrooms. " <br /> There were no more comments from the Board. There were no comments from the Building <br /> Commissioner or audience. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Furbush so moved. Mr. Reidy <br /> second. All were in favor. <br /> Mr. Bonvie asked for a motion for the application. Mr. Reidy made a motion that the Board issue <br /> a Written Finding for 18 Starboard Lane with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Site Plan — 18 Starboard Lane, Prepared for Shallow Shores, LLC, Date: Sept. 5, 2025, <br /> Prepared by Cape & Islands Engineering, Signed and stamped by Mark Dibb, Civil Eng. <br /> No.: 45937 and Matt Costa, PLS,No: 52282. <br /> 3. Design Plans— 18 Starboard Lane, Scale: 1/4"= 1',Date: 10/14/2025, Revised: 12/22/2025, <br /> Drawing No. Al: First and Second Floor Plan, A2: Basement and Section Plan, A3: Left, <br /> Right, Front and Rear Elevation Plans.
