Fuess Partners Structural Engineers Date: 12/12/25. <br /> New plans related to elevations must be stamped by a professional land surveyor prior to <br /> submission of a building permit. All revised construction plans must comply with the <br /> Zoning Enforcement Officer. If revised plans do not comply with the Zoning <br /> Enforcement Officer, the applicant must return to the Zoning Board of Appeals. <br /> 4. The Board finds under §174-17 and §174-33 that the proposed project is not substantially <br /> more detrimental than the pre-existing, nonconforming structure or use to either the Town <br /> or the neighborhood. <br /> Ms. Sangeleer, second, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Furbush, yes, <br /> Mr. Reidy, yes, <br /> Mr. Bonvie, yes, <br /> All were in favor of a Written Finding. <br /> 367 Mashpee Neck Road: Owners, Gary M. and Linda Oldham, Trustees of the Oldham Nominee <br /> Trust request a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze and <br /> replace an existing single-family residential structure with a new single-family residential structure <br /> on property located in the R-3 Zoning District, Map 90, Parcel 55, Mashpee, MA. (Continued <br /> from 12110125 hearings at the request of the Attorney). <br /> Sitting on this hearing are the four regular Board members and Mr. Morizio. <br /> Attorney Christopher Kirrane represented the applicants for the raze and replace project. This <br /> property is located in the R3 zoning district. The zoning requirements in the R3 zoning district are <br /> 40,000 sq. ft. minimum lot area 150 ft of frontage, 40 ft front yard setbacks, 15 side and rear in <br /> this particular case this lot is partially affected by the flood zone so our lot area is 8,359 sq. ft. <br /> which is under 10,000 ft and allows a 25% maximum lot coverage and a 50 ft. setback from <br /> wetlands. <br /> 7 <br />
