<br /> Attorney Rachel Watzke, on behalf of the applicant,presented the project on remand following prior appeals. The
<br /> original 2023 Notice of Intent proposed a single-family home with deck,pervious driveway, advanced septic system, access
<br /> platform and stairs to the waterfront, and restoration of previously disturbed areas, including mitigation plantings. The
<br /> project was denied by the Commission in 2023, approved by DEP through a Superseding Order of Conditions in March
<br /> 2024, and remanded back to the Commission by Superior Court in April 2025. The court found that areas proposed for work
<br /> had been previously cleared under earlier permits and therefore did not qualify as"naturally vegetated area"under the
<br /> regulations,requiring reconsideration by the Commission.
<br /> Commissioners raised numerous concerns,the absence of a waiver request, adequacy of mitigation and landscaping,
<br /> accuracy and age of soil logs,nitrogen calculations and septic system performance in a DEP-mapped Nitrogen Sensitive
<br /> Area, flood risk based on updated Morris Data Viewer projections, and potential impacts to coastal bank, salt marsh, and
<br /> groundwater. Additional concerns were noted regarding house siting and size within buffer zones,foundation type, lack of
<br /> detailed construction methods, driveway design,retaining walls, and the platform,ramp, and float configuration, including
<br /> anchoring, stability, and whether the system effectively functions as a dock within an ACEC.
<br /> Staff and consultants responded that some plan notes require correction, additional documentation could be provided
<br /> (including DEP general permits and anchoring details), and further coordination with the applicant would be needed to
<br /> address the Commission's concerns. The Commission provided a comprehensive list of items requiring clarification or
<br /> revision before further consideration.
<br /> The applicant requested, a continuance to March 5, 2026,to allow time to prepare responses, updated plans, and
<br /> additional supporting information.

<br /> Chuck Rowland of Cape and Islands Engineering presented the continued Notice of Intent for residential
<br /> improvements at 30 Captain's Row on behalf of Matthew S. and Jennifer Kielty. The proposal includes removal
<br /> and reconstruction of an existing deck, a residential addition,relocation of the existing septic tank to
<br /> accommodate the addition, installation of two dry wells, and associated mitigation. The project continues from the
<br /> December 11, 2025. Chair Cook recused himself due to a conflict as applicant was a former client, and the
<br /> hearing was chaired by Vice Chair Thornbrugh.
<br /> The property is fully surrounded by roadways, with the Mashpee River woodlands to the northwest. No
<br /> wetland resource areas are located on the lot; the nearest coastal bank and land subject to coastal storm flowage
<br /> are off-site. The work occurs partially within the 75-100 foot buffer zone, triggering mitigation. The applicant
<br /> proposes approximately 1,018 square feet of mitigation planting to offset 509 square feet of disturbance. The
<br /> project does not increase the number of bedrooms.
