(cons.2.05) 43- <br /> 3258 <br /> Staff reported that the applicant had requested a continuance to April 23, 2026, in order to allow additional time <br /> to respond to the Commission's requests for additional soil testing and installation of a groundwater monitoring <br /> well on the site,particularly in connection with the anticipated high tides expected around April 17-18. <br /> Chair Cook noted that he would not be present at the April 23, 2026, meeting. Mr. Colombo expressed concern <br /> that Chair Cook's absence could affect the Commission's deliberations, as the Chair has been involved in prior <br /> discussions, including those held in executive session. It was suggested that the matter might instead be continued <br /> to the following meeting in early May so that all members involved in prior discussions could participate. <br /> Staff explained that the applicant had specifically requested the April 23, 2026, continuance, and because the <br /> applicant or their representative was not present at the meeting, the Commission could not unilaterally change the <br /> requested date. Therefore, if the Commission voted to continue the hearing to April 23, 2026, the applicant would <br /> need to appear on that date to request further continuance to the subsequent meeting if necessary. <br /> The Commission discussed whether it could set the continuance to an alternative date but concluded that because <br /> the applicant had not authorized another date and had no representative present, the Commission would need to <br /> vote on the requested April 23, 2026, continuance, with any additional continuance to be requested at that time. <br /> MOTION: To continue 190 Monomoscoy Road to April 23, 2026 <br /> Motion by: Sandi Godfrey Seconded by: Richard Sahl <br /> Discussion: Mr. Colombo's would vote in favor of the continuance with the <br /> hope that the hearing would be ultimately moved to a later meeting <br /> so Chair Cook could be present. <br /> Vote: Motion passed by unanimous vote. <br /> (Steve Cook,Paul Colombo, Sandi Godfrey, Seana Pitt,Richard Sahl) <br /> NOl 399 Nlonomoscoy Road, Tranquility Developers LLC. (coast. 1.22/2.05) 43- <br /> 3389 <br /> Mr. Kent reported that the applicant was requesting a continuance to March 19, 2026, to allow time to revise the <br /> plans. Following a recent meeting with the homeowner, it was explained that the owner no longer wished to <br /> pursue a dock height of approximately 6 feet 9 inches, which had been proposed to allow public access <br /> underneath the structure. Instead, the owner would prefer to lower the dock height to approximately 5 feet 4 <br /> inches to 5 feet 9 inches and incorporate stairs within the dock structure to provide public access. <br /> Mr. Kent further explained that the revised proposal would include Chapter 91 public access through deeded <br /> rights, allowing the public to use the stairs to pass along the shoreline. <br /> During the discussion, Mr. Colombo asked whether the Commission had received a comment letter from the <br /> Division of Marine Fisheries (DMF)regarding the proposal. Mr. Kent confirmed that a letter had been received. It <br /> was noted that with the reduction in dock height, it would be important to review the plans to ensure the structure <br /> would still meet the required ratio for shading over the salt marsh.
