MASHPEE ZONING BOARD OF APEALS <br /> Meeting Minutes <br /> February 11, 2026 <br /> Mr. Reidy read the Board of Health comments into the record; House in zone 2 <br /> and to remain two-bedroom floor plan shows one bedroom on first floor and one <br /> bedroom on second floor. No doors on office or den study. <br /> Mr. Reidy read the Conservation Department comments into the record; <br /> Resource areas coastal bank buffer zone to salt marsh and LSCSF. Notice of intent <br /> application was approved with the unanimous vote of the commission due to <br /> improvements to the property. Permit was approved with conditions of a three-year <br /> restoration monitoring plan with a certified professional planting of native bushes <br /> in the lawn area abutting the salt marsh and treatment plan for the frag mites on <br /> site. <br /> There were no more comments from the Board. There were no comments from <br /> the audience. <br /> Ms. Sangeleer asked for a motion to close the public hearing. Mr. Furbush made <br /> a motion to close the public hearing. Mr. Blaisdell second. All were in favor. <br /> Mr. Reidy made a motion asking that the Board issue a Special Permit with the <br /> following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Special Permit under Mass General Law 40A Section 9. <br /> 2. Site Plan-Proposed House for 126 Waterway, prepared for Theodore Stoia, <br /> Plan Date: November 18, 2025, Plan Scale: 1" = 20', Revised: 1/29/26: <br /> Revise Garage Depth From 20' to 21'. Revised Lot Coverage. Prepared by: <br /> Falmouth Engineering, stamped and signed by Michael Borselli, No. 35054 <br /> PE, and Gary S. Labrie, No. 40039, PLS. 1/30/26. <br /> 3. Building Plans: Stoia Residence, 126 Waterway, Date: January 28, 2026, <br /> A-2: First Floor Plan, A-3: Second Floor Plan, A-4: Elevations, A-5: <br /> Elevations. Prepared by: Archi-Tech Associates. <br /> 4. Conditioned on all Town Department comments read into the record <br /> including but not limited to the Board of Health and Conservation <br /> Department comments. <br /> S.
