MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APEALS <br /> MARCH 25, 2026 <br /> Attorney Amy Kwesell, Town Counsel for this project addressed the Board and <br /> stated that the Board has 180 days (September 22, 2026) to render its decision. She <br /> suggested that the Board secure peer review for civil engineering. She suggested <br /> that the Board secure the next meeting with enough time for the peer reviewer to <br /> provide a report. Ms. Kwesell also suggested that the Board reaches out to (MHP) <br /> Mass Housing Partnership for further technical assistance. <br /> The Board has reached out to Tighe and Bond to provide peer review and is waiting <br /> for their proposal. That proposal should be submitted to the applicant's Attorney, <br /> and those funds will be deposited in a 53G account with the Town Accountant. Ms. <br /> Kwesell confirmed that Tighe and Bond is certainly qualified for peer review services, <br /> and they will provide a report on for the Board and the developer to address all <br /> concerns. The peer reviewer will mark the technical items as "addressed" and how <br /> they were addressed. The Board can also designate dates to address certain topics. <br /> She suggested that the Board discuss civil engineering for the next hearing that <br /> includes parking and fire department access. <br /> Mr. Reidy wanted to know if the Board should meet with the peer reviewer to discuss <br /> the topics discussed at this meeting. Ms. Kwesell said the Board could meet with <br /> the peer reviewer but is not required. <br /> The Board wants to make sure that any project changes are brought to their <br /> attention. <br /> Attorney Haverty mentioned that he does not anticipate any changes being made <br /> prior to receiving peer review comments but is certain that once those comments <br /> are submitted there will be changes. <br /> Attorney Kwesell believes that there will be extensions past the 180-day <br /> requirement, and the Board can ask for those extensions. <br /> Mr. Reidy made a motion that the Board accept Tighe and Bond to perform peer <br /> review services for the 40B Project "On Commons" based on the following; <br /> 1. Traffic Study, Density, Size, Fire, Architecture, Civil Engineering, Setbacks <br /> from Rte. 28, including but not limited to review of the site plans, parking, <br /> elevations, and drainage and outdoor recreational space for families and <br /> children. <br /> 2. This motion also includes that the applicant provide a check for$10,000 made out <br /> to the Town of Mashpee for engineering services performed by Tighe and Bond <br /> under a 53G account, and if the account is drawn down to $2,500 the applicant <br /> will be notified and is required to replenish the account with a $5,000 check. <br /> 20 <br />
