MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APEALS <br /> MARCH 25, 2026 <br /> Mr. Haverty will address all the concerns raised at this meeting and throughout this <br /> process. <br /> Ms. Sangeleer is concerned with the massing, and the density of this building. <br /> Mr. Haverty said that of necessity this is more dense than typical development <br /> patterns. The additional market rate units carry the freight for the affordable units <br /> that are required to be provided which is why the density is greater. When the Board <br /> issues a decision with an approval of conditions, that approval will have to prove <br /> that it doesn't render the decision uneconomical. If those conditions render the <br /> approval uneconomic, the client will have to make an appeal to the housing appeals <br /> committee, and the housing appeal committee can be favorable to developers. It's a <br /> direct tie between the number of units and the economics of the building. <br /> Ms. Mary Wagan spoke and noticed that the Board had already discussed some of <br /> her concerns that were in her letter. She mentioned that the Planning Board has <br /> been working with the Mashpee Commons master plan for decades, and regarding <br /> their waste treatment plan they indicated that they have 180 acres but do not have <br /> enough discharge capacity for that whole 180 acres. They want to address Mass <br /> DEP to expand that area but there is an issue to expand because the treatment <br /> plant discharge affects the embayment. If they apply to DEP there will be some fierce <br /> review from DEP because they will not allow expansion. Mary suggested this waste <br /> treatment issue with Mashpee Commons and know where this wastewater is going <br /> especially where there is future development by Mashpee Commons. Mary also <br /> mentioned the Architectural and parking issues and suggested that be discussed <br /> with the peer reviewer. <br /> Ms. Sangeleer mentioned that the Board of Health Agent mentioned that in his <br /> comments. <br /> A resident of 82 Shellback Way has concerns with traffic. <br /> Ms. Lynn Barbie addressed the Board and had concerns for people with disabilities, <br /> and there is no playground area for children. <br /> 19 <br />
