MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APEALS <br /> MARCH 25, 2026 <br /> Mr. Bonvie mentioned that the last five items listed are not under ZBA jurisdiction, <br /> but he reviewed them. He mentioned that the MEPA file above and beyond the <br /> Gunter Lane ramifications regarding the shellfish. There are more items listed under <br /> the MEPA file that may need to be addressed, and not sure if that is under the <br /> jurisdiction of the Board. Mr. Bonvie pointed out he spent two days reviewing this <br /> file. He reiterated the request of conditions listed on his question and comment <br /> form. The Board did not have any questions. <br /> Mr. Bonvie reviewed the process he followed for transparency of this project. All the <br /> resident letters were posted on the website along with the Agenda. He reached out <br /> to the Town Clerk, who reached out to the State's Attorney General office and agreed <br /> that these letters can be managed that specific method. <br /> Mr. Bonvie addressed the audience and allowed only three (3) minutes of discussion <br /> and no repetition of comments. <br /> Attorney William Henchy approached the Board, and he represents twenty-eight <br /> (28) residents for this application. He asked what members of the Board were <br /> present at the last hearing on February 11, 2026. Mr. Goldstein said he was not <br /> present but read the draft minutes of the last hearing on February 11, 2026. Mr. <br /> Hency mentioned that only the members present at the last hearing can participate <br /> unless that member has viewed the video or read the minutes. Mr. Bonvie <br /> mentioned he was at the meeting via zoom and read the minutes. Mr. Henchy <br /> mentioned that he did not receive Mr. Drainville's supplemental information of <br /> 5,000 pages that was sent to the Board on February 20, 2026. Mr. Bonvie said he <br /> reviewed 200 pages. <br /> Mr. Henchy stated he sent a letter dated March 24, 2026, to the secretary requesting <br /> the Board continue the hearing. Mr. Bonvie responded that only the applicant can <br /> request a continuance. Mr. Henchy wanted to state for the record that Attorney <br /> Eichman prepared a memorandum prepared for the Board on February 20, 2026, <br /> and it was not submitted to the Board until Friday of last week. He said that he <br /> received a copy of that memorandum and too late to respond so that the Board <br /> would have the opportunity to hear his response. Mr. Henchy stated that in his <br /> experience that material submitted a month later to the Board and not enough time <br /> for the abutters that are in litigation to respond. He believes he was ambushed with <br /> a month-old memo that was only submitted to the Board on Friday. He mentioned <br /> he did not receive the documentation from Mr. Drainville. He stated that he has <br /> never seen that in a Town on Cape Cod such a blatant attempt to bushwack counsel. <br /> He represents several taxpayers in the Town and those of the Town's constituents <br /> as well as the proponents on this project. He said he is prejudiced and objects. <br /> 5 <br />
