of TMs s,s
z.
Aannin Board
c
16 Great Neck Road North
.wlashpee, Aassachusetts 02649
They are mounding in a way DEP didn't think. There are some engineering issues where it can
mound up too high and it could start to flow into areas like a drinking well.
CHAIRS REPORT
No Report.
TOWN PLANNER REPORT
Short Term Rentals
Mr. Tobin stated there is a bylaw adjustment approaching with the Select Board and Town
Meeting. There are three options for Warrant Articles. The first two came from Town Counsel.
Option 1 allows a primary dwelling to be used as a short-term rental.
Option 2 allows accessory use for short-term rental, 30-day use.
Option 3 allows short term rentals for primary use, only for residents that have received a
short-term rental certificate, allow as accessory use across the board. Our code never
expressly said it was allowed, which likely stopped corporations or investors from purchasing.
If someone has received a short-term rental certificate in the past as a primary use, there is an
accessory use increase. If you are living in a house year-round, you could leave or rent a
room, as long as you were mostly living there. This gives us time to investigate corporate bans,
alleviate negative impacts, and allow the right to do it. We need to remain proactive. It will be
applied to the zoning bylaw because we have a general bylaw. The case reference to this is
still on appeal, and this is in response to that court case.
Mr. Tobin will go before the Select Board Monday evening so he would like a vote this evening.
Ms. Faulkner, Mr. Balzarini, and Mr. Milbury all say yes. Ms. Waygan likes option 3. Mr. Hansen
asked that the handout be saved for him when he comes back in April.
Naukabout Beer Company
Mr. Tobin noted there are some site adjustments with a retaining wall on the backside. A lot of
adjustments were made to the parking lot.
Ms. Waygan inquired about the cargo container still visible. There is lot of landscaping they
never did. They want that hill to be kept in the most natural state. It's a very sensitive site.
There are pallets as well.
21
