MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 8, 2026 <br /> Mr. Morris agreed with Attorney Kirrane's calculations because of the pre- <br /> existing condition of the house and it's a very uniquely shaped lot. He also agrees <br /> that the 119 sq. ft. shed should be moved back 5 ft. from the property line, and <br /> the basketball should be moved back to the property line as well. <br /> Mr. Riedy read the Board of Health comments dated April 7, 2026, into the <br /> record; Tank to be moved. No new flow, house to remain 3 bedroom while <br /> connected to Septic. Conservation Department comments dated April 6, 2026. <br /> "Resource Areas: Buffer zone to Coastal Bank. NOI application was approved <br /> unanimously due to improvements to natural vegetation on the property as well a <br /> majority of the proposed work is outside of jurisdiction. Condition of a two-year <br /> mitigation monitoring contract with a certified professional." <br /> There were no comments from the audience. There were no more comments from <br /> the Board. <br /> Ms. Sangeleer asked for a motion to close the public hearing. Mr. Furbush so <br /> moved. Mr. Caggiano second. All were in favor. <br /> Discussion regarding a motion <br /> Mr. Reidy asked about the conditions. Ms. Sangeleer stated; fix the basketball <br /> court so it is situated on the property line on all sides from Town property, move <br /> the 119 sq. ft. shed 5 ft. from the property line (off Town property), and that Mr. <br /> Bonvie review the drainage plans, and submit a revised site plan. <br /> Mr. Morris said he will review the as-built plan when submitted with the building <br /> permit. <br /> Mr. Reidy made a motion that the Board approve the Written Finding for 30 <br /> Captains Row with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Written Finding under Mass General Law 40A Section 6. <br /> 2. Plot Plan - 30 Captains Row, Sheet 1 of 1, Date: October 16, 2025, <br /> Prepared by Cape & Islands Engineering, Stamped and signed by: Jacob <br /> Fricke, Registered Land Surveyor, No.: 59305, date: 10/16/25, and <br /> Charles Rowland, PE, No.: 52699, Date: 10/16/25. <br /> 3 <br />
