Fin Com-Regu la r Session <br /> August 21,2025 <br /> Jared confirmed due diligence is ongoing and acknowledged that alternate sites <br /> exist but are less feasible within the current funding timeline, as theywould require <br /> purchasing privately owned lots with more neighbors. <br /> McKelvey questioned the timing and legal opinions surrounding the taxtaking of the <br /> property, noting concerns about the validity of legal advice. Town Manager Rodney <br /> Collins clarified that preliminary verbal legal opinion from KP Law was <br /> supplemented by detailed written title search from subcontracted experts. This <br /> opinion was provided to the Sewer Commission and Select Board and is considered <br /> the town's official legal position. <br /> Catherine Laurent addressed the committee regarding Article 16, which concerns <br /> proposed road taking. She explained that any road the town takes over will be <br /> brought up to current standards to protect both the town and taxpayers.While the <br /> town's budget for maintenance, including labor, tree trimming, and sign <br /> replacement—will increase only minimally overthe next ten years, major costs are <br /> expected after that period when pavement begins to deteriorate. She noted that the <br /> typical lifespan of a road is 20 to 30 years, after which maintenance expenses <br /> significantly rise. When asked about the current condition of the road, Laurent <br /> stated that the plan is to completely rebuild it. <br /> Additionally, Article 10 was discussed, which relates to stormwater regulations. It <br /> was explained that since 2003, the EPA has imposed requirements on <br /> municipalities, including Mashpee, which falls within an urbanized area governed <br /> by both EPA and Massachusetts DEP regulations.
