It was stated that the continuance had been requested due <br /> to extensive discussion at the prior hearing regarding the related vista application. The applicant sought additional time <br /> to incorporate the Commission's decision on that matter into the boardwalk plans. Proposed removal of the existing timber wall and replacement <br /> with a new vinyl sheet pile wall, permit the existing pier, and install native vegetation plantings. <br /> (Representative: Cape and Islands Engineering, Inc.) (cont. 4.23) 43- <br /> 3414 <br /> The Commission continued review of a Notice of Intent for 17 Sunset Circle regarding the proposed removal <br /> of an existing timber retaining wall and replacement with a new vinyl sheet pile wall, permitting of an existing <br /> pier, and installation of native vegetation plantings, represented by Cape and Islands Engineering. The <br /> applicant's representative stated that the property abuts John's Pond and currently contains an existing timber <br /> retaining wall composed of vertical timber posts proposed for replacement. The project was described as <br /> including construction of a new approximately 60-foot-long vinyl sheet pile wall with tieback rods and <br /> deadman, installation of drainage features to relieve hydrostatic pressure, restoration of grades following <br /> construction, installation of approximately 175 square feet of native plantings, and permitting of the existing <br /> pier operating under an interim Chapter 91 license. It was further stated that all work would occur within <br /> previously disturbed areas and that erosion controls including silt fence and straw waddles would be installed <br /> during construction. <br /> Discussion addressed comments received from Natural Heritage and Endangered Species Program staff <br /> regarding shellfish monitoring requirements associated with the project. It was stated that a biologist would <br /> likely be required to inspect the work area for shellfish prior to construction activities, and the applicant's <br /> representative stated willingness to comply with all recommended conditions. Commissioners also requested <br /> additional information regarding the size and type of boats proposed to utilize the pier, noting that dock <br /> regulations require such information regardless of whether the dock is located in freshwater or saltwater. <br /> Additional discussion focused on the existing pier configuration and whether the length and seasonality of the <br /> dock were appropriate. Concerns were raised regarding the need for the pier to extend approximately 50 feet <br /> into John's Pond given the available water depths closer to shore. Questions were also raised regarding <br /> discrepancies between the narrative and plans concerning whether the dock would remain seasonal or <br /> permanent. It was stated that the final determination regarding seasonality may depend on recommendations <br /> from state agencies and Natural Heritage review.
