Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> Colombo stated that, in his opinion, the proposal did not comply with Regulation 1, Part B, Section 2(A), (B), <br /> and(C) governing amended orders because the project had significantly changed from the previously <br /> approved plan. Concerns were raised regarding the expanded patio area, increase in parking area, changes to <br /> the structure, lack of detailed landscape plans, incomplete erosion control details, additional stormwater <br /> management needs, and inconsistencies between the prior approved foundation repair and the newly proposed <br /> full rebuild project. Additional concerns were raised regarding septic system design assumptions, nitrogen <br /> loading calculations, missing dry well information, and the lack of a complete landscape mitigation plan. <br /> Discussion also addressed the applicant's assertion that the closest point of disturbance to the coastal bank <br /> remained unchanged because the proposed patio occupied the same general area as an existing deck. <br /> Commissioners acknowledged that while the setback distance may not have changed, the overall scope and <br /> nature of the project had materially changed from the previously approved foundation repair proposal. <br /> MOTION: To deny the request for an Amended Order of Conditions based on Regulation 1, <br /> Part B, Section 2(A), (B), and (C) as the project had significantly changed and <br /> therefore required a full NOI. <br /> Motion by: Paul Colombo Seconded by: Sandi Godfrey <br /> Discussion: Before a vote was taken, the applicant requested an opportunity to continue the <br /> matter in order to revise and potentially scale back the proposal rather than receive an <br /> immediate denial. It was stated that the applicant wished to reconsider aspects of the proposal <br /> and determine whether revisions could be made that would satisfy the Commission's concerns <br /> while avoiding the need to restart the permitting process through a new Notice of Intent filing. <br /> Conservation staff then explained the rationale for initially recommending the project as an <br /> Amended Order of Conditions, stating that the original approval already involved substantial <br /> foundation work and septic upgrades and that expansion of the limit of work would trigger <br /> additional lawn reduction and native planting requirements, potentially creating environmental <br /> benefits. It was further stated that the work remained generally within the same approved <br /> foundation footprint despite the transition from foundation repair to raise-and-rebuild <br /> construction. Following further deliberation, Paul Colombo stated that he would be willing to <br /> withdraw the motion to deny if the applicant returned with a scaled-down proposal and with the <br /> understanding that the Commission could still determine that the project required a full Notice <br /> of Intent filing if substantial changes remained.
