We can't <br /> just waive that, it would be a ZBA variance, if they wanted to keep it as is. Her point, the Board <br /> should consider now, is if the wall is within the 10ft. property line or include a condition for the <br /> wall to be moved. It's her opinion, moving the wall back won't change site design, parking, or <br /> stormwater, just the wall. There is 10ft. to property line to wall to parking. That is her <br /> recommendation and she still needs the Boards interpretation of that article. <br /> Mr. Hansen stated that is a 15ft. grass area with a stone wall somewhere in that 15ft., located <br /> 5ft. from property line. If it was closer to parking, it would satisfy the bylaw and not change the <br /> basic description. <br /> Ms. Waygan noted leaving it there meets the intent of the bylaw. When asked if everyone <br /> agreed, it was acknowledged to leave it. <br /> Mr. Tobin brought up Mr. Kirrane's point about the delivery trucks entering from the entrance at <br /> Route 28 only. <br /> Ms. Christy stated trucks enter from Route 28 and they are good to exit via Shellback Way. <br /> Ms. Waygan is fine for them to exit off Shellback Way. <br /> Mr. Tobin stated if trucks are to be limited to the Shellback exit, it has to be written. One pro to <br /> limiting would be decreasing use of Shellback. The con is the applicant has stated it poses <br /> challenges to their delivery route upon return. <br /> Ms. Waygan commented about garbage trucks and a condition on time of day. During summer <br /> they start work early to get around traffic, some developments hear them come at 4:OOAM. We <br /> would like to limit operation. <br /> The Trader Joes representative answered cardboard goes back onto the food trucks, while a lot <br /> of food they cannot sell is donated. They do not end up with a lot of trash, it may come once or <br /> twice a week. <br /> Mr. Kirrane confirmed adding acceptable hours of trash pickup to no earlier than 7:OOAM. <br /> MOTION: <br /> Dennis Balzarini made a motion to close the public hearing.
