Seconded by Dennis Balzarini. <br /> All in favor. <br /> Mr. Tobin agreed to update the draft for the Board to review with the comments incorporated <br /> from this evening. There are some substantive changes. The red lines in this meeting packet <br /> were red lines that were sent to Attorney Kirrane and the applicant as department changes to <br /> his proposed conditions. He would like to accept those changes for the next draft so that those <br /> redlines will reflect only new changes. He would also like to make a decision on the additional <br /> consulting hours. The Town does not want to burden the applicant and will defer to the <br /> consulting engineer to see how much time is appropriate regarding Condition #13. <br /> Mr. Kirrane stated the 40 hours were removed from the original. <br /> Mr. Tobin read Number 13, where the applicant agrees to work with the Town, MassDOT, and <br /> the Commission to implement targeted mitigation efforts. The applicant agrees to make <br /> engineers available for consultation at the cost of the applicant. <br /> Mr. Bogosian noted this is in addition to work they are already doing, granting access to their <br /> engineers, to continue to make sure the $250,000 is exhausted. <br /> Attorney Kirrane clarified that the 40 hours is just for the Town to avail itself of exclusive peer <br /> review hours the Town's engineers may otherwise need, and exclusive of when the applicant's <br /> engineers are working with MassDOT when the Town is not at the table. <br /> Mr. Tobin agreed that clarity makes sense and would draft wording to reflect it. <br /> Mr. Lucas believes 40 hours is fair. Since it was clarified as separate to the permitting effort, <br /> but it doesn't specify that the traffic engineer is working on other solutions. If there are <br /> questions from these entities the engineer is available. That is fine. <br /> Mr. Kirrane brought up the crosswalk signal beacons. <br /> Mr. Tobin commented the beacons are on the crosswalk which is private property and not in <br /> the right of way. The bike path is a Town-owned easement on the parcel. <br /> Jason Adams with Bowman stated MassDOT will require those facilities be under operation of <br /> the state. MassDOT would take the easement as they won't want private property on their <br /> equipment.
