MASHPEE ZONING BOARD OF APPEALS <br />Meeting Minutes <br />June 10, 2026 <br /> <br />Mr. Furbush wanted to know if a permit is required prior to removal of any trees. <br />Mr. Morris said; yes, from the Town Planner prior to issuance of a building permit. <br /> <br />Mr. Furbush had a discussion and reviewed the site plan with Mr. Foley regarding <br />the retaining walls. <br /> <br />Mr. Morris said that the building code for a wall is measured from the height above <br />the ground of the bottom of the footing to the top of the wall. A building permit is <br />required for a 4 ft. wall. <br /> <br />Mr. Foley said the new wall that separates the driveway from the backyard is just a <br />landscape structure. <br /> <br />Mr. Morris mentioned that a 2 ft. wall could be considered the same as a patio. <br /> <br />Mr. Reidy asked if the trees should be depicted on the site plan. Mr. Foley said that <br />there are trees depicted on this plan. There is one tree located 20 ft. from the street <br />and will be replaced with two smaller trees. <br /> <br />Mr. Bonvie wanted confirmation that the “x” marks on the plan are existing trees <br />that will be removed. <br /> <br />Mr. Bonvie suggested that Mr. Foley have a conversation with Mr. Morris to confirm <br />that the 2 ft. retaining walls are allowed and whether or not included in lot coverage, <br />that Mr. Foley has a conversation with the abutters regarding the trees and the Tree <br />Bylaw. (The Board generally conditions the application to include approval from the <br />Town Planner regarding the Tree Bylaw prior to the issuance of a building permit.) <br />The site plan needs to be revised to depict a diagram of a parked vehicle, and to <br />make sure that the septic system is vented as requested by the Health Agent. <br /> <br />Mr. Foley asked for a continuance until Wednesday, July 8, 2026. Mr. Bonvie asked <br />for a motion to extend the hearing. Mr. Reidy so moved. Mr. Furbush second. All <br />were in favor. <br /> <br />9 <br /> <br /> <br />
