04%k1M { <br /> Town of Mashpee Shellfish Commission <br /> : z 16 Great Neck Road North <br /> Mashpee,MA 02649 <br /> SHELLFISH COMMISSION <br /> MEETING MINUTES of JUNE 9, 2026—6:OOPM <br /> MASHPEE TOWN HALL— 16 GREAT NECK ROAD NORTH <br /> WAQUOIT MEETING ROOM <br /> PRESENT: Chair Peter Thomas, Shellfish Constable Chris Avis, Vice Chair Richard Cook, Clerk <br /> Darryl Christensen, and Associate Members Dwight Pfundstein and Jamie Pachico <br /> ABSENT: Member Bill Holmes and Associate Member Buddy Pocknett <br /> CALL MEETING TO ORDER: Chair Thomas called the meeting to order in Open Session in the <br /> Waquoit Meeting Room at 6:OOPM. <br /> PUBLIC COMMENT: None. <br /> MINUTES: Discussion and approval of May 12, 2026, Shellfish Commission Meeting minutes. <br /> MOTION: To approve and accept May 12, 2026, minutes. <br /> Motion by: Darryl Christensen Seconded by: Richard Cook <br /> Vote: The Motion passed unanimously. <br /> COMMUNICATIONS AND CORRESPONDENCE: <br /> None discussed. <br /> OLD BUSINESS: <br /> Update on the Quiterio Aguaculture Grant <br /> DNR Director Robert Tomaino provided an update regarding the violations observed at the Great River <br /> Boat Ramp involving Mr. Quiterio's aquaculture grant and Cape Cod Oyster. Mr. Tomaino stated that he <br /> had not yet had an opportunity to redact the report but that any Commission member interested in <br /> reviewing the report could request a redacted copy through the Chair. <br /> Mr. Tomaino reported that on May 1, 2026, while conducting a directed patrol at the Great River Boat <br /> Ramp, he observed oyster seed, oyster gear, and Cape Cod Oyster personnel in the area. Following an <br /> investigation conducted in coordination with the Environmental Police and the Division of Marine <br /> Fisheries (DMF), it was determined that oyster seed was being removed from Mr. Quiterio's grant site <br /> and transported off-site for culling, which was not authorized under the terms of the permit. Mr. Tomaino <br /> stated that both Mr. Quiterio and Cape Cod Oyster personnel acknowledged that they knew Mr. <br /> Quiterio's permit did not authorize off-site culling. He further reported that individuals working on the <br /> grant site were not listed on Mr. Quiterio's DMF permit. <br /> Mr. Tomaino reported that the investigation resulted in multiple citations issued under 322 CMR <br /> regulations. Cape Cod Oyster received four citations totaling $800, including violations of 322 CMR 16 <br /> for failure to maintain a required human waste bucket on board a vessel, 322 CMR 16 for shellfish <br /> tagging violations, 322 CMR 7 for truck permit violations, and 322 CMR 15 for unauthorized <br /> aquaculture activity.
