MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
JUNE 24, 2026
Ms. Lynne Barbee wants to see affordable housing in Town and wanted to remind
the Board that comments were submitted a year ago that are similar to the
comments mentioned tonight. She commented that this is not the best location
for this building and agreed with Mr. Riggs comments that more open space is
required.
There were no more comments from the audience.
Attorney Haverty wanted to address the comments from the last meeting
regarding the wastewater project. He thought there was some sort of agreement
with Mashpee Commons and the Town to connect with the schools. He contacted
Counsel for Mashpee Commons and there were some discussions but there is no
official agreement.
The Board gave Attorney Haverty a document titled; "Restated and Amended
Agreement Between The Town of Mashpee and Mashpee Commons, LP For the
Treatment and Disposal of Wastewater". Mr. Haverty was told by Mashpee
Commons Attorney that there was no agreement made between the Town and
Mashpee Commons other than the permits that have been connected, anything
else would be under the discretion of Mashpee Commons. He will review this
document. He had no other comments.
Lynne Sweet suggested this conversation be discussed during the civil peer
review discussions at the next meeting on July 8, 2026, but she wanted to make
sure there would be enough time to review the engineering and enough time for
the developer to comment on any concerns.
Attorney Haverty mentioned that the engineer would be able to be present at the
next meeting but may not be able to provide a written response.
Ms. Sangeleer asked for a motion to continue. Mr. Reidy made a motion to
continue the hearing until Wednesday, July 8, 2026, to receive the report of the
civil engineer consultant, and any further information that the developer has to
present to the Board.
Mr. Furbush second. All were in favor. Mr. Furbush asked if the engineer would
provide a presentation and submit that to the Board before the meeting.
Attorney Haverty stated he will submit any written responses if available to the
Board prior to the next meeting.
The Board will need to sign the "Mullen Form" (G.L. c. 39 Section 23D), if absent
from a particular meeting to make certain they can participate in any discussions
going forward on this project.
10
