MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 24, 2026 <br /> The Board had a discussion and disagreed with this comment. They notice a lot <br /> of foot traffic around that area of Route 28 and Jobs Fishing. There are no <br /> sidewalks. <br /> Lynne Sweet thanked everyone with their discussions and would like the <br /> development team to review the peer review consultant's presentation and will <br /> be expecting the traffic peer review on Tuesday, next week. This could include <br /> the fire department's comments and intermingle with the traffic discussion. <br /> There are commonality concerns with Daniel's presentation and the Cape Cod <br /> Commission's letter. She cautioned the Board that it's wonderful to have a wish <br /> list but a 40B has a higher requirement standard which is the health and safety <br /> issues and to make sure that during the traffic discussions may be a good time <br /> for the fire expert to join a meeting. <br /> Attorney Amy Kwesell had no comments. <br /> Mr. Morris agreed with the Board's comments but is concerned with the 1.5 <br /> parking spaces. He agreed with Mr. Reidy's comments and the presentation. The <br /> Board wants equal amount of parking with the number of units. <br /> Ms. Mary Waygan, who resides on Ashumet Road and is a Planning Board <br /> Member. She is representing herself. She viewed the video dated May 27, 2026, <br /> and asked if the application was posted online. She commented that the project <br /> does not have any recreational facility or playground area. She mentioned that <br /> Mashpee is considered a nitrogen sensitive area by the State and is also subject <br /> to intermunicipal agreement for nitrogen control with the Town of Sandwich and <br /> Barnstable and that the State approved a management plan of a flow neutral <br /> bylaw. She cannot see how this development can be accommodated without <br /> strict conditions with wastewater management. She provided the Board the 40B <br /> that was approved by the Town of Sandwich and noted that; "The project is <br /> subject to a No Net Nitrogen impact due to the IMA dated November 13, 2017". <br /> She thanked Daniel Riggs for his presentation. She mentioned that the eligibility <br /> letter that was submitted to the State did note that this project would comply <br /> with Mashpee Commons Architectural Standards. It would be helpful for the <br /> public if Daniel could review the standards. She also agreed that the height of <br /> the building and the close proximity to the street is a safety issue. She would <br /> prefer the building material to be the Cape Cod style. She suggested that the <br /> Board look at the building on Sea Captains Row in Hyannis, Yarmouth <br /> Commons, and Edgartown. <br /> Lynne Sweet asked Mary Waygan to submit those comments to the Board. <br /> 9 <br />
