Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> The revised plans restored the vegetated buffer along the top of the bulkhead,reduced lawn area, and incorporated stormwater <br /> management improvements. Reference was also made to legal counsel's opinion regarding the Commission's authority to <br /> regulate nitrogen loading below 19 parts per million. <br /> Commission members discussed the projcct's nitrogen loading,the property's location within a wellhead protection area, and <br /> legal counsel's opinion. Discussion focused on the Commission's authority to require nitrogen concentrations below 19 parts <br /> per million,the basis for applying a 10 parts per million standard, and whether the project's proposed nitrogen loading of 12.9 <br /> parts per million was acceptable given the anticipated future sewer connection. <br /> The Commission also discussed the existing septic system,including its age, condition,location, and the potential for impacts <br /> during construction. Questions were raised regarding whether the existing system should be replaced as part of the project, <br /> whether construction activities could affect the system, and whether additional information was needed to evaluate potential <br /> cumulative impacts. <br /> The applicant stated that the existing septic system was a functioning Title 5 system and that replacement was not required <br /> under applicable regulations. The applicant further indicated a willingness to have the septic system inspected and to provide <br /> additional information regarding its condition. <br /> Conservation staff advised that there were no specific regulatory requirements mandating replacement of the existing septic <br /> system but noted that additional information regarding the system could assist the Commission in evaluating the project. Staff <br /> further advised that the Commission could request additional information regarding groundwater flow,water quality, and <br /> other factors identified in Regulation 30 if the Commission wished to further evaluate potential cumulative impacts. <br /> Following discussion,the Commission agreed that additional information regarding the existing septic system and the criteria <br /> identified in Regulation 30 would be helpful in evaluating the application.
