Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> patio area relative to the existing deck, additional native plantings and lawn reduction near the coastal bank, <br /> stormwater management calculations demonstrating compliance with the 25-year storm event, expanded <br /> erosion controls, and updated nitrogen-loading calculations. The applicant stated that the revised proposal <br /> would provide environmental benefits beyond both existing conditions and the previously approved project <br /> through installation of the FAST septic system, improved setbacks from the coastal bank, removal of lawn <br /> area, additional native plantings, expanded stormwater management measures, and the use of pervious patio <br /> surfaces. The applicant further stated that the proposed expansion was primarily vertical and that the overall <br /> scope of earthwork and site disturbance would remain substantially similar to the previously approved project. <br /> During Commission discussion, concerns were raised regarding nitrogen-loading calculations for the property, <br /> which is located within a wellhead protection area. A Commissioner questioned the recharge rates used in the <br /> calculations and stated that application of the Commission's standard recharge assumptions would result in <br /> higher nitrogen concentrations than those presented. The Commissioner noted that the project remained <br /> subject to pending legal guidance regarding nitrogen limits within wellhead protection areas and stated that <br /> revised calculations may be necessary depending on the outcome of that review. Additional discussion <br /> focused on whether the proposed changes constituted a substantial change in the scope and purpose of the <br /> previously approved project. Several Commissioners expressed the view that replacing the approved <br /> foundation-replacement project with a complete raze-and-rebuild project represented a substantial <br /> modification requiring the filing of a new Notice of Intent rather than an Amended Order of Conditions. <br /> Concerns were also raised regarding expansion of the structure, additional patio area, the adequacy of the <br /> proposed landscaping plan, and coastal resiliency considerations associated with the property's location. <br /> Commissioners also discussed the property's location within an area identified by the Morris Data Viewer as <br /> being susceptible to future coastal flooding and noted that the pending legal review regarding septic systems <br /> in wellhead protection areas could affect the project. Staff explained that legal counsel had been asked to <br /> provide guidance regarding interpretation of the Commission's septic system regulations and nitrogen-loading <br /> standards within wellhead protection zones. <br /> Following a poll of the Commission, a consensus was reached that the proposed changes constituted a <br /> substantial change in scope and purpose and should proceed as a new Notice of Intent rather than as an <br /> Amended Order of Conditions. The applicant subsequently requested permission to withdraw the Amended <br /> Order of Conditions application without prejudice in order to file a new Notice of Intent. <br /> MOTION: To allow the applicants request to withdraw the Amended Order of Conditions application <br /> without prejudice in order to file a new Notice of Intent for 29 Jeep Place. <br /> Motion by: Sandi Godfrey Seconded by: Richard Sahl <br /> Vote: Motion passed unanimously by roll call vote. <br /> Steve Cook,Paul Colombo, Sandi Godfrey,Richard Sahl, Seana Pitt <br /> In response to a question from the applicant regarding the septic system concerns, staff explained that if legal counsel <br /> determined that nitrogen concentrations within wellhead protection areas must be reduced to 10 milligrams per liter,the <br /> applicant may need to reevaluate the property's overall nitrogen loading. Staff noted that compliance could potentially <br /> be achieved through landscape modifications on some properties, while smaller properties may require redesign of the <br /> septic system. Staff emphasized that no conclusions should be drawn until legal counsel provides guidance and stated <br /> that a response was hoped for before the Commission's June 25 meeting, as several pending applications are awaiting <br /> clarification on the same issue. <br /> 14 <br />
