Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> Further discussion focused on the intent of Regulation 25, the Commission's consideration of future sea <br /> level rise, and the role of the MORIS Data Viewer in evaluating potential adverse environmental impacts. It <br /> was noted that the regulation was developed following presentations and guidance from coastal resiliency <br /> experts and agencies, and that future inundation projections are intended to be considered as part of the <br /> Commission's review process. Concern was expressed that no information had been submitted describing <br /> how the septic system would function during future flood events or what measures would be taken should <br /> the system become inundated. It was suggested that, while the Commission may not have authority to <br /> require replacement of a functioning septic system, it could require submission of an emergency response or <br /> management plan addressing projected future inundation conditions. Discussion also occurred regarding <br /> whether the issue of septic systems located in flood-prone areas should be added to the list of questions <br /> currently pending review by Town Counsel. <br /> Following discussion, there was general agreement that an emergency plan addressing the septic system and <br /> future inundation impacts identified through the MORIS Data Viewer should be submitted as a condition of <br /> any approval. The Commission also agreed that the broader issue of septic systems within projected flood <br /> zones should be included among the matters being referred to Town Counsel for further guidance. <br /> MOTION: To close the hearing for 45 Nehoiden Road with the following conditions: <br /> 1. The applicant shall provide Conservation staff with an emergency response plan <br /> addressing projected 2050 flooding and inundation conditions affecting the septic <br /> system. <br /> 2. Existing arborvitaes proposed for relocation shall be successfully transplanted and <br /> maintained. Any arborvitaes that do not survive shall be replaced. <br /> 3. A two-year monitoring period shall be required for the relocated and/or <br /> replacement arborvitaes. <br /> Discussion: During discussion of the motion, Mr. Colombo stated that no construction should <br /> occur until the required emergency response plan had been submitted to Conservation staff. The <br /> Commissioner further requested that the plan be distributed to all Commissioners for review <br /> once received. Due to <br /> structural concerns identified during project planning, the applicant was now proposing a raze-and-rebuild <br /> project in substantially the same footprint rather than reusing the existing structure. The representative <br /> reviewed revisions made in response to prior Commission comments, including clarification of septic system <br /> setbacks, confirmation that the proposed home would remain a three-bedroom dwelling, reduction of the rear <br /> 13 <br />
