Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> reduced by approximately 1.5 feet, while still maintaining sufficient room for seating, maneuvering, and <br /> ADA-related access around the pool. <br /> The Commission discussed whether the proposed pool should remain within the 75-foot buffer to the coastal <br /> bank. Concern was expressed that the pool was still in substantially the same location as previously proposed <br /> and that the pool and patio could potentially be shifted or reconfigured to reduce or eliminate work within the <br /> 75-foot buffer. It was noted that the Commission has generally required pools to be shifted, reduced, or <br /> redesigned to avoid buffer impacts where feasible. Other members noted that the proposal included significant <br /> mitigation and site improvements, and that the pool was being proposed for therapeutic and accessibility <br /> reasons rather than ordinary recreational use. The applicant's team explained that the pool location was driven <br /> by the needs of the family member who would use it, including visibility from the home,proximity to the <br /> house, safe access, and adequate maneuvering space around the pool. <br /> The applicant's representatives also stated that moving the pool closer to the house raised construction <br /> concerns, including potential impacts to the foundation, the need for excavation around the pool, equipment <br /> access, and required construction clearance. A commissioner disagreed that the construction concerns made <br /> relocation impossible and suggested that modern construction methods could allow the pool to be placed <br /> outside the 75-foot buffer. <br /> Attorney Wall and the project team discussed their interpretation of Regulation 16, stating that the regulations <br /> allow work within 150 feet of a coastal bank so long as the work does not destroy the bank or impair its <br /> stability or functions.
