It was noted that an extension had already been granted earlier in the year due to severe weather <br /> conditions and that the Commission had agreed to maintain the March 1 through November 1 restriction thereafter. <br /> Several members stated that allowing pruning during the nesting season would be inconsistent with that decision <br /> and with the purpose of the seasonal restriction. <br /> In response to a question regarding the timing of the request, Ms. Taylor explained that the Order of Conditions had <br /> been issued after the pruning window had closed and that the applicant had hoped the bird nesting survey would <br /> provide a basis for obtaining authorization to proceed during the summer. <br /> Staff clarified that requests for waivers from regulatory conditions are considered by the Commission and are not <br /> solely a staff determination, despite the language contained in the Order of Conditions. <br /> Following discussion, the Commission reached a consensus that the request should not be granted. Staff reported that they were still awaiting guidance from legal <br /> counsel and anticipated that the opinion would help clarify several outstanding regulatory questions and provide <br /> direction for future reviews. It was noted that once the legal response is received, it will be distributed to the <br /> Commission, and staff will discuss the contents with the Chair and Vice Chair before determining how best to <br /> proceed. <br /> The Commission also discussed its upcoming reorganization vote. Staff noted that the next scheduled meeting on <br /> June 25, 2026, would ordinarily include the annual reorganization. Commissioners expressed a preference to <br /> conduct the reorganization when all members could be present. Staff explained that reorganization is not mandatory <br /> and that the previous Select Board policy requiring annual reorganization had been rescinded. It was further noted <br /> that the Commission has traditionally preferred to conduct reorganization with full membership present. <br /> Following discussion, the Commission reached a consensus to postpone the reorganization vote until the July 23, <br /> 2026, meeting, when all members were expected to be available.
