(Representative: DCR and WBNERR Ryan <br /> Clark) <br /> Ryan Clark, Stewardship Coordinator for the Massachusetts Department of Conservation and Recreation <br /> (DCR) and the Waquoit Bay National Estuarine Research Reserve (WBNERR), presented a Request for <br /> Determination of Applicability (RDA) for temporary repairs and accessibility improvements at South Cape <br /> Beach. <br /> Mr. Clark explained that the outermost approximately 50 feet of the existing beach access boardwalk had <br /> sustained significant storm damage and, due to ongoing landward migration of the coastal dune system, was <br /> no longer sustainable to maintain in its current location. DCR proposes removing the damaged section of <br /> boardwalk and installing a seasonal accessibility mat (MOBI mat) extending from the shortened boardwalk to <br /> the beach. The mat would be installed and maintained each summer through DCR's Universal Access <br /> Program. Mr. Clark stated that the proposal was intended as a temporary measure while DCR develops plans <br /> for a future full boardwalk replacement and broader beach operations management plan. <br /> Concerns were raised regarding a June 4, 2026, correspondence from the Massachusetts Natural Heritage and <br /> Endangered Species Program (NHESP), noting the letter referenced a time-of-year restriction prohibiting <br /> work between April I and August 31 unless otherwise authorized. Questions were raised whether the <br /> Commission should act before NHESP had clearly approved work within the restricted period. <br /> The Commissioners were advised that they could condition any approval upon compliance with all NHESP <br /> requirements and receipt of any necessary approvals or amendments from NHESP. Mr. Clark stated that he <br /> had consulted with NHESP prior to filing the RDA and had submitted a Massachusetts Endangered Species <br /> Act(MESA) checklist. He explained that NHESP had reviewed the proposal and issued a determination letter <br /> containing conditions for the project.
