Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> to conduct shorebird monitoring and install protective fencing at South Cape Beach and would comply with <br /> all NHESP requirements. <br /> Commissioners discussed the need for additional clarification from NHESP regarding authorization to work <br /> within the restricted period. Mr. Clark agreed to provide the Commission with supplemental correspondence <br /> from NHESP containing additional details regarding monitoring requirements and project implementation. He <br /> also agreed to provide monitoring reports generated through Mass Audubon's shorebird monitoring program. <br /> There were questions regarding whether the work should instead require a Notice of Intent(NOI)because it <br /> occurs within coastal resource areas. It was explained that staff accepted the filing as an RDA because the <br /> proposal involved removal of an existing structure and installation of a temporary accessibility mat rather than <br /> construction of a new boardwalk. Following discussion, commissioners agreed that the proposed work was <br /> limited to removal of the damaged boardwalk section and installation of the seasonal accessibility mat, with <br /> any future boardwalk replacement to be submitted separately through a Notice of Intent process. <br /> Mr. Clark estimated that removal of the damaged boardwalk section would take several hours and that <br /> installation of the MOBI mat would occur on a separate day, ideally before Father's Day weekend. <br /> Several commissioners expressed support for issuing a negative determination with conditions requiring <br /> compliance with NHESP requirements and submission of monitoring information to the Commission prior to <br /> commencement of work. <br /> MOTION: To issue a Negative Determination for the RDA at 494 Great Oak Road, subject <br /> to all conditions contained in the Natural Heritage and Endangered Species <br /> Program (NHESP) comment letter, including required monitoring and reporting <br /> measures, and with the additional condition that no work shall commence until <br /> the Conservation Commission and Conservation Department receive written <br /> confirmation from NHESP regarding authorization to conduct the work within <br /> the applicable time-of-year restriction period. <br /> Motion by: Paul Colombo Seconded by: Sandi Godfrey <br /> Vote: Vote passed unanimously by roll call vote <br /> (Steve Cook, Paul Colombo, Sandi Godfrey Richard Sahl, Seana Pitt) <br /> AOCC 9 Santuit Lane,R Investments LLC. It was <br /> explained that the Commission had previously approved an Order of Conditions in March 2025 for <br /> demolition of the existing dwelling, which was constructed in 1953, served by a non-functioning cesspool, <br /> and was located in close proximity to the pond. The approved project included construction of a replacement <br /> single-family residence located farther from the pond, installation of a denitrifying septic system, and <br /> associated mitigation plantings. The property was subsequently sold before any work was performed under <br /> the permit. The new owner proposed modifications to the previously approved design and filed a request to <br /> amend the Order of Conditions. <br /> 5 <br />
