Quiterio <br />The Board reviewed the recommendation to revoke Aquaculture Grant #14, Permit <br />#187277, issued to Joao C. Quiterio. Quiterio was not in attendance despite having been <br />notified by certified mail. <br />It was asked whether this type of action was common. Sta? explained that, due to the <br />violations observed, the department determined that revocation of the permit was <br />necessary. It was further stated that the violations were serious enough to present health <br />and safety concerns, as outlined in the memorandum provided to the Board. Although this <br />was the permit holder's first documented violation, sta? considered the violations to be <br />severe and significant. The seriousness of the violation was acknowledged by the Board. <br /> It was asked about the Town's typical approach to enforcement, noting that revoking a <br />permit a?ects an individual's livelihood. Town Sta? responded that the department <br />generally emphasizes education before enforcement and that the recommendation to <br />revoke the permit was not made lightly. <br />The Chair of the Shellfish Commission explained that concerns had been raised during the <br />original application process regarding the applicant's past conduct. The Commission <br />ultimately approved the application by a split vote, with the Chair casting the deciding vote. <br />The Chair stated that the decision was made because there was insu?icient evidence to <br />deny the application based on hearsay alone, but it was made clear at the time that any <br />future violations would result in the matter returning before the Shellfish Commission and <br />the Select Board. <br />Motion made by Selectwoman Wyman-Colombo to approve the recommendation to <br />Revoke Aquaculture Grant #14, Permit #187277, Joao C.
