MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 22, 2026 <br /> Mr. Reidy made a motion to move that I move that Appeal AP-2026-29 be denied <br /> as the Zoning Board of Appeals does not have the jurisdiction to adjudicate the <br /> Appeal as the May 12, 2026, Request for Determination sought a determination <br /> as to frontage shown on an endorsed ANR plan and was not properly before the <br /> Building Commissioner and Zoning Board of Appeals pursuant to G.L. c. 40A, <br /> §§ 7 & 8 and Zoning Bylaw Section §174-103. <br /> Ms. Sangeleer second. All were in favor to deny the Appeal AP-2026-29. <br /> ADDITIONAL TOPICS <br /> (This space is reserved for topics that the Chairman did not reasonably anticipate <br /> would be discussed.) <br /> Chairman Bonvie addressed the Board and discussed the new bylaws that were <br /> approved by the Governor of the State. He provided the Board a green folder that <br /> had specific information referencing the Variance applications that include <br /> significant zoning reforms designed to facilitate the production of housing in <br /> Massachusetts. <br /> Amy Kwessel, Town Counsel reviewed the new bylaws and provided the Board a <br /> hand-out from KP Law that documents the specific changes to M.G.L. c. 40A <br /> (Chapter 40A) Sections 5 and 11, (notice requirements), Section 6 (pre-existing <br /> nonconforming uses and structures and freeze protections), and Section 10 <br /> (variances). <br /> OTHER BUSINESS <br /> ➢ Approve July 8, 2026, Meeting Minutes. <br /> Mr. Bonvie asked for a motion to approve the meeting minutes. Mr. Furbush so <br /> moved. Ms. Sangeleer second. All were in favor. <br /> CONTINUED HEARINGS <br /> Route 28 and Jobs Fishing Road: Petitioner, On Commons LLC C/O, Blatman, <br /> Bobrowski, Haverty & Silverstein, LLC is requesting a Comprehensive Permit <br /> under M.G.L. 40B §§20-23 to construct sixty-five (65) rental units, including <br /> seventeen (17) affordable units on a 1.86-acre site located at the corner of Job's <br /> Fishing Road and Falmouth Road (Route 28), on property located in a C-1 Zoning <br /> District, Map 74, Parcel 20A-3, Mashpee, MA.
