Chairman, Ronald Bonvie, Board Members Jonathan
D. Furbush, William A. Blaisdell, Scott Goldstein, Sharon Sangeleer, and
Associate Members, George Ganzenmuller, Charles Reidy, and Michael Morizio
were present. Building Commissioner David Morris was also present.
Chairman Bonvie opened the meeting at 6:00 pm and announced that the
hearings were being televised live on Mashpee TV. He will take comments after
each hearing.
CONTINUED HEARINGS
9 Tuspaquin Road: Owners, Mario and Gina Recupero request a Special Permit
under§174-17.1, §174-17, and §174-31 of the Zoning Bylaws to raze an existing
one car garage with a new one car garage in the same footprint with living space
above on property located in an R-3 Zoning District, Map 72, Parcel 8, Mashpee,
MA. (Continued from July 22, 2026, hearings).
Mr. Mike Cannata represented the homeowners. The last hearing was continued
to allow the applicant time to consult with the Board of Health Agent regarding
comments regarding the open space above the garage. Mr. Cannata also had a
conversation with the Building Commissioner who provided clarification
regarding the open space area.
Mr. Reidy read the Building Commissioner's comments dated July 23, 2026, into
the record; "I have reviewed the proposal that was continued on July 22,2026. In
my opinion, the space above the proposed garage is clearly not intended to be used
as a sleeping unit. I am also of the opinion that the proposed space does not fully
meet the building code definition of a sleeping unit. (see attached). To ensure the
space is to be used as intended, I will condition that the space is not to be used as
a sleeping unit on the CO. I suggest that the Board put a similar condition in their
decision."
1
