MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 12, 2026 <br /> Mr. Reidy read the Board of Health comments dated August 12, 2026, into the <br /> record; "Property to remain 2 bedrooms as long as it is connected to Septic. Space <br /> above garage does not meet requirements for Bedroom and cannot be used as a <br /> bedroom." <br /> The Board had a conversation and wanted clarification that the countertop and <br /> sink were removed from the first floor of the open space. It was not considered a <br /> kitchen. <br /> There were no more comments from the Board or audience. <br /> Chairman Bonvie asked for motion to close the public hearing. Mr. Furbush so <br /> moved. Mr. Blaisdell second. All were in favor. <br /> Mr. Reidy made a motion that the Board approve the project at 9 Tuspaquin <br /> Road with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Special Permit under Mass General Law 40A Section 9. <br /> 2. Plot Plan - 9 Tuspaquin Road, Prepared for: Mario and Gina Recupero, <br /> Date: June 1, 2026, Proposed Garage Plan, Prepared and signed by: Cape <br /> 8v Islands Engineering, Jacob Fricke, PLS, No: 59305 and Charles <br /> Rowland, PE, No.: 52699. Date 6/ 1/2026. <br /> 3. Floor Plans: First Floor Plan, Second Floor Plan dated July 23, 2026. <br /> 4. Conditioned on all Town Department comments read into the record <br /> including but not limited to the Board of Health and Conservation <br /> Department comments. <br /> 5. Conditioned that space above garage cannot be used as a bedroom. <br /> 6. Any changes to the plans will require the applicant to return to this Board. <br /> 7. Conditioned that the applicant seeks and obtains the Planning <br /> Department review in reference to the Tree Bylaw Chapter 175 of the Town <br /> Bylaws prior to the application of a building permit. <br /> 2 <br />
