MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 12, 2026 <br /> 8. The Board finds under §174-17.1, §174-17, and §174-31 that the <br /> proposed project as submitted is not substantially more detrimental to the <br /> neighborhood than the existing conditions, prior to removal of the existing <br /> structure, and that the site plan depicts adequate land area on the subject <br /> lot to provide sufficient parking, and there are no new nonconformities <br /> being created. <br /> Ms. Sangeleer second, yes, <br /> Mr. Furbush, yes, <br /> Mr. Goldstien, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Bonnie, yes. <br /> All were in favor to issue a Special Permit. <br /> NEW HEARINGS <br /> 45 Nehoiden Road: Owner, Richard H. Gorbaty requests a Written Finding <br /> under §174-17 of the Zoning Bylaws to allow for construction of a front entry <br /> addition in place of an existing deck, a living room addition in place of the rear <br /> deck, and a bathroom addition to the primary bedroom to a pre-existing <br /> nonconforming structure on property located in an R-3 Zoning District, Map 125, <br /> Parcel 116, Mashpee, MA. <br /> Mr. Geoff Bright with Synergy Home Improvements represented the homeowner <br /> requesting some changes, extensions to the existing dwelling. Mr. Bright <br /> explained to the Board that the homeowners want to redesign their space to <br /> provide better access and mobility.This project was before the ZBA last year and <br /> was withdrawn by the applicant to seek the required order of conditions from the <br /> Conservation Commission. <br /> Mr. Morizio read the Board of Health comments dated August 12, 2026, into the <br /> record; "Floor plans are not understandable. First floor has a "master bedroom" <br /> that looks like a bathroom, a "bedroom"that is an access to the "master bedroom". <br /> Second floor has 2 plans;first plans show a "Kitchen"at top of stairs the 2nd has <br /> a "master bedroom at top of stairs. I st plan shows a "bathroom" connected to a <br /> "Kitchen/living room" while the 2nd plan shows those as a "room" connected to a <br /> "bathroom". BOH cannot determine bedroom count. Site plans show 2 leaching <br /> pits, BOH has no record of 2nd pit, were they both actually located?" <br /> 3 <br />
