BOARD OF APPEALS TI"UTES WEDNESDAY, FEBRUARY 20, 1985 At 7:38 p.m. on 'Wednesday, February 20, 1985, the Board of Appeals held a meeting at the Mashpee Town Hall. Board members present and acting throughout were: Manuel Costa, Michael i'iakunas, William Hanrahan and Thomas Sexton. Also- present was Doug Boyd. g�rqf-ory Jon Willis - requested a Variance under Section 7.4 of the Land Space Requirements for permission to vary the 40 ' road setback requirements on property located on the Corner Lot #117 - ighview Ave. , Hilltop Rd. , Bria.rwood Estates, ,�iashpee, F..ass. 'Tr. 'Willis represented the Alloring's in this matter. Nr. Willis went on to explain that there was a topography problem due to the fact the land slopes and there is a grade problem. In addition to this the Board had accepted letters from Raymond K. Loughlin, Ed. D. , Psychologist and James L. ':icGuire, N1 .D. ?c.r. Boyd had viewed the property and felt that there was a topography problem. Both Mr. Boyd and i4r. Willis had provided the Board with photographs of the property. Attached to these minutes are copys of the letters from both doctors. ,1r. Hanrahan made a notion to grant the Variance of 14 feet finding the hardship to be both topographical and medical, Mr. Sexton seconded the motion all agreed. Osterville Cheese Shod AZ ?/a The Gourmet i+iarket .lace - requested a Special Permit under Section 6 . 3 of the .Land Use Requirements for permission to add a limited dining area for patrons on property located at Deer Crossing, Route 28, Ylashpee, :;ass. 1r. Burton explained that he wanted to provide a limited dining area for patrons with 5 tables and 22 seats. ;VIr. Burton continued that the plates, cups and such would all be disposable. Mr. Burton also mentioned he discontinued the sale of ice cream. Mr. Costa asked if he had a beer and wine license. Mr. Burton told the Board that it.was a package store license. Mr. Sexton asked what percent of his business was take out. Mr. Burton told the Board that it was about 50% of his business.
