MINUTES March 23, 2000 5 BOARD OF HEALTH
Mr. Ball stated, "If I understand this correctly, beyond the credits, if Life
does not hook into Talanian property, are they under the impression that
they do not have to put in their own dente?"
Mr. McQuaid responded, "No. They were told that if something happens
with the Talanian project, they agreed that if something happened to the
Talanian project they would put in a denite. That's in the minutes."
Mr. Doherty stated that the letter is clearly inaccurate and needs to be
corrected.
Mr. Cram motioned to amend the letter to the Cape Cod Commission
from Health Agent Elias A. McQuaid to correct statements that do not
reflect the opinions of the Board. Mr. Doherty seconded the motion.
Motion passed.
APPOINTMENT: Dino Mitrokostas re: John's Pond Center seating capacity
Mr. Dino Mitrokostas was in attendance for this scheduled appointment.
Mr. Mitrokostas presented his plans to open an outdoor dining area at Finally Dino's
and Dino's Sports Bar at the John's Pond Center.
Mr. McQuaid indicated that last September the Board had agreed with the reduced
flow calculation from 35 to 20 based on usage of paper instead of china and based on
the existing septic system's capacity.
Mr. McQuaid stated, "It would meet the requirements that Dino is proposing as far as
expansion goes with the exception of the grease trap. We required Dino to submit to
us a copy of the contract with a licensed pumper to maintain the grease trap
accordingly and to pump it as required. This was all approved and Dino was getting
ready to move forward on his proposal. He's before you to just review this application
and ask for a second letter of support to the DEP if that's your position."
Mr. Ball pointed out that earlier in the meeting Deer Crossing Market and Deli was
looking for the same thing and the Board told him that they wanted to see
denitrification.
Mr. Mitrokostas indicated that Deer Crossing has not gone to the DEP yet and that he
had already requested the reduction from the DEP. He further indicated that the
septic flow for the entire center comes to 5570 and that the system is designed to
accommodate 8000 gallons per day.
Resident Stephanie Jones asked how the Board's nitrogen regulation would affect this
project.
Mr. McQuaid stated that the nitrogen regulation affects new construction or projects
undergoing a change in ownership. John's Pond Center would not be affected by this
regulation since they are expanding an existing use.
