MINUTES May 31, 2001 2 BOARD OF HEALTH <br /> Board members expressed their dismay at the fourth violation coming only a very <br /> short time after their third violation, which was earlier this spring. Mr. Santos stated <br /> that he would not be in favor of reducing the 60-day suspension. <br /> Discussion took place regarding what measures could be put in place by the Mobil <br /> Station to ensure that further sales of tobacco products to minors would not happen. <br /> The Mobil station representatives also requested that Board members reconsider the <br /> 60-day suspension as it was greatly hurting their business. <br /> The Mobil station representatives showed Board members a new unit being tested in <br /> other stations called an "IdentiScan" which is used to scan in drivers licenses prior to <br /> a sale to determine the buyers age. They indicated that they could get the unit <br /> operating in the Mashpee store immediately and it would be used prior to every sale of <br /> tobacco products in an effort to stop sales to under age buyers. <br /> Board members also discussed with Mobil station representatives the possibility of <br /> them sponsoring a seminar for local tobacco retailers and residents about tobacco <br /> sales education. <br /> Mr. Ball motioned to rescind the 60-day suspension of the Mobil stations tobacco sales <br /> license conditional upon sponsoring a tobacco sales education seminar within 15 days <br /> and installation of the "IdentiScan" unit prior to any further tobacco sales (inspection <br /> of the unit by Ms. Warden necessary). Mr. Doherty seconded the motion. Mr. Santos <br /> was opposed to the motion. Motion passed. <br /> APPOINTMENT: Jason Simon/Star Market re: Smoking Violation <br /> Mr. Jason Simon, Manager and Mr. Don Keefe, Service Manager of the Mashpee Star <br /> Market were in attendance for this scheduled appointment. <br /> Mr. Simon came before the Board to discuss the Mashpee Star Market's recent <br /> tobacco sales violation and subsequent fine imposed by the Board. Mr. Simon <br /> brought Board members up to date on the company's training and sales policies with <br /> regard to tobacco sales. He apologized to the Board members for the violation and <br /> stated that the employee in question had immediately been terminated. <br /> Discussion took place regarding the policies of the Board with regard to tobacco sales <br /> violations and Star Markets'ongoing controls of tobacco sales. Mr. Simon stated that <br /> the company takes this issue very seriously and is working hard to be sure that no <br /> further violations happen. <br /> APPOINTMENT: Vito Marotta re: variance request at 159 Falmouth/Sandwich Road <br /> Mr. Vito Marotta was in attendance for this scheduled appointment. <br /> Ms. Warden stated that Mr. Marotto is proposing a 6-bedroom home on his lot at 159 , <br /> Falmouth/Sandwich Road. The Board has a current regulation stating that any septic <br /> system with a flow in excess of 600 gallons per day will require a denitrification unit. <br /> Mr. Marotta's 6-bedroom home would produce a flow of 660 gallons per day and he is <br /> requesting a variance to not install the denitrification unit. <br />
