MINUTES May 31, 2001 5 BOARD OF HEALTH <br /> 9. Definitive Subdivision Plan Linwood/Soliz: 66 & 72 Main Street and 2 Amos <br /> Road <br /> Board members reviewed the application for a Definitive Subdivision Plan of <br /> land located at 66 & 72 Main Street and #2 Amos Road. <br /> Mr. Ball motioned to approve the definitive subdivision plan and Mr. Santos <br /> seconded the motion. Motion passed. <br /> 15. Request for Retail Food and Tobacco Sales Permits - Robert Vidal (out of <br /> sequence) <br /> Mr. Robert Vidal of East Coast Wholesale was in attendance for this agenda <br /> item. <br /> Discussion took place regarding Mr. Vidal's request to sell various pre-packaged <br /> food items and tobacco items at Dick & Ellie's Flea Market. Mr. Vidal had <br /> previously held a permit in 1998 for the same purpose. He indicated that no <br /> one else is selling tobacco at the flea market and that 90% of his sales are to <br /> other vendors at the market. <br /> Mr. Santos motioned to grant a 2001Retail Food Permit and 2001 Tobacco <br /> Sales Permit to Mr. Robert Vidal dba East Coast Wholesale. Mr. Ball seconded <br /> the motion. Motion passed. <br /> 10. Variance request: 56 Waterway <br /> The applicant is requesting a variance of 10'from the front property line to the <br /> soil absorption system and a variance to not designate a reserve leaching area. <br /> Discussion took place regarding the plans submitted and the Board's concern <br /> over the proximity of a vent to the drainage easement. <br /> Mr. Doherty stated, "The Board is rejecting the plan due to lack required <br /> distances from the delineated drainage easement and the establishment of the <br /> system vent in the middle of the drainage easement." <br /> Mr. Ball motioned to deny the variance request. Mr. Santos seconded the <br /> motion. Motion to deny passed. <br /> 11. Smoking Violation: Mike's Service Station <br /> Mr. Doherty stepped down from discussion on this matter. <br /> Ms. Warden informed Board members that the certified letter sent to Mike's <br /> Service Station regarding their Tobacco Sales permit violation has not been <br /> received as yet and that she hasn't received a receipt or a"green card". <br /> Mr. Ball recommended that the Health Agent has a Mashpee Police Department <br /> officer hand deliver a new letter and that the owner of Mike's Service Station <br /> will have 10 days from the receipt of the letter to address the violation. <br />
