MINUTES July 5, 2001 2 BOARD OF HEALTH <br /> Mr. Santos motioned to grant a Food Establishment permit to Legal Seafoods to <br /> operate an outdoor clambake from July 1st, 2001 through August 31, 2001. Mr. Ball <br /> seconded the motion. Motion passed. <br /> 4. Variance request—39 Little Neck Lane <br /> The applicant is requesting a 4.5'variance from the leaching facility to the <br /> property line. A 5'variance from the septic tank to the property line, a 29' <br /> variance from the coastal bank, a local variance of 79'from the leaching facility <br /> to the coastal bank and a local variance of 17'to the wetland. <br /> Discussion took place among Board members regarding the need for a <br /> denitrification unit due to the close proximity to the wetland. Further <br /> discussion took place regarding the best location for the proposed sytem. <br /> Mr. Ball motioned to deny the variance requests as outlined in a cover letter <br /> from Down Cape Engineering dated June 28, 2001. Mr. Santos seconded the <br /> motion. Motion to deny passed. <br /> APPOINTMENT: Cape & Islands Engineering re: 186 Ninigret Avenue <br /> Mr. David Sanicki of Cape & Islands Engineering was in attendance for this scheduled <br /> appointment. <br /> Ms. Warden stated, "I requested David to come tonight because he's got a situation <br /> here where there is a failed system and there is standing water at 43 inches." <br /> Mr. Sanicki stated, "The system is over 100' from the wetlands, that's not the issue." <br /> "It is a failed cesspool system. The concern of Ronnie's (Ms. Warden) is that when we <br /> did the soil test there was some fill right to the groundwater. Ronnie's concern is that <br /> this is going to be a mounded system. Because of the groundwater at 43" we've taken <br /> the bottom of the system down to 4' and that puts us above grade with the bottom of <br /> the system. It's about V to the bottom of the system. We're trying to keep this <br /> shallow system 6" with a field." "But I'm respecting the groundwater 4', but now this <br /> is a mounded system with a containment structure around the exterior of it. That's <br /> going to be at elevation 74.5. So we're about 2-'/s'out of the ground here. But to <br /> respect the groundwater here, I'm putting in a tank with a pump chamber and then <br /> coming into this mounded system. That's the only way I can do this to get the 4' above <br /> the groundwater." <br /> Ms. Warden asked for clarification on various aspects of the plans. Board members <br /> discussed the plans and any possible alternatives to having a mounded system, which <br /> have rarely been approved by the Board. <br /> Mr. Ball motioned to approve the plans and variance request as outlined in a cover <br /> letter from Cape & Islands Engineering for 186 Ninigret Avenue due to the <br /> groundwater issues. Mr. Santos seconded the motion. Motion passed. <br />
