6
Mr. Ball stated that the 7' that he is asking for is not required by DEP Title V
requirements. You can put the reserve anywhere. He would, however, like to keep
them coming to the BOH to ask for the variance. But, as far as notifying the
abutters on a tear down. If it was new "yes" otherwise it is not necessary.
Mr. Ball stated that he already made his motion. Mr. Santos seconded the motion.
6. Variance Requests: 196 Waterway
The applicant is requesting a number of variances in order to maintain 100' from
the salt marsh. The variances requested are as follows: The soil absorption system
and reserve will be 5' off the easterly property line. The soil absorption system will
be 4' off the street property line. The reserve will be zero feet off the street property
line. Due to the BOH request on 08.06.01 they have added a denitrification unit to
the septic system.
Mr. Ball made a motion to grant the variances as requested as noted in the Cape
& Island letterhead dated July 23rd and August 30th, 2001. Mr. Santos seconded
the motion.
7. Weston & Sampson & BOH Agreement for F.Y. '02 Landfill Eng. Services
Ms. Warden began by stating that she has not be able to research the information
listed in the letter as to exactly what amount was appropriated for the landfill.
Furthermore, she would appreciate her name being taken off of the agreement.
Ms. Warden believes that the Board of Health should be the name on the
agreement.
Mr. Ball so moved to grant that request. He also stated that the Board request
that they solicit other companies for contract bids. He wanted to request that
Greenseal and Sterns &Wheeler provide us with contract bids if they show any
interest.
Mr. Santos then stated that on "Phase D" annual solid waste report to DEP was
not needed because they were concentrating on that issue. Weston & Sampson is
already moving forward on the reduction on monitoring of the landfill gas issue.
Ms. Warden stated that the DEP denied the request for the reduction the last
time.
Mr. Santos continued by saying that with this amount of money with "30 B" they
just can't give them the job. The only way around this is that they have an
existing contract. The BOH can do an addendum explaining why they are sticking
with Weston & Sampson.
Ms. Warden stated that the BOH does have an engineering services account. The
account number 336 in the "Trash" accounts. She then asked the administrative
assistant, Charlotte Garron, if this particular trash account was returned to us
after the remainder of the trash accounts transferred to the DPW. Ms. Garron
stated that the BOH was not paying for any of the trash accounts. Ms. Warden
