Minutes of Personnel Board <br /> October 25, 1982 Page 2 <br /> • Meeting with the Selectmen and the Executive Secretary, cont. <br /> enforce the contract and that it was the transition period which was the problem. <br /> Caroline asked when the contract was ratified? <br /> The Executive Secretary replied that it does not take effect until the funds are <br /> authorized by town meeting; however, it had been ratified by the Selectmen. <br /> Curtis asked if the Personnel Board was still responsible? <br /> The Executive Secretary replied that he would say so. He told the Board that there is <br /> no fault being laid. The idea is to clarify what is going to happen in the future. <br /> Sel. Garland said that the appearance of the firefighters was proper and so was the <br /> determination made by the Personnel Board. <br /> Caroline made reference to the vacation clause under the Firefighters Contract stating <br /> that it had not been carried out properly and that the Personnel Board's decision was <br /> correct. She asked if it is spelled out and clarified in the new contract? <br /> The Executive Secretary explained that there were only four issues negotiated for this <br /> year; that being, clothing and equipment allowances, salaries, longevity and reduction <br /> in force and with the next round of negotiations the issue of vacation can be addressed. <br /> • Sel. Garland explained that this was the second year of a two-year contract. <br /> The Executive Secretary told the Personnel Board that in _a month from now they will <br /> start negotiating for next July 1, 1983 and then it would be for the full contract. <br /> Sel. Garland explained that if the Board of Selectmen had approved the financial as- <br /> pects and a straight two-year contract with no re-openers, it would have been enforced. <br /> He further explained that they would have to fund the second year under the law. The <br /> directions that the Unions are taking today is that. they are hedging their bets. They <br /> are discussing re-openers. The town was limited to just four items. <br /> The Executive Secretary told the Board that they tried to throw a little curve on one <br /> item and it was recognized right away. <br /> Sel. Garland commented that they were stopped short. The firefighters would have the <br /> right of an appeal to the labor relations board for bargaining in poor faith. <br /> Caroline told the Board of Selectmen that she did not realize that they were limited to <br /> four items; however, she felt the problem was still unresolved. She made mention of <br /> the fact that it was quotted that the Personnel Board had no business making decisions. <br /> The Executive Secretary told the Board that what has happened is that the attorney is <br /> preparing language on behalf of the town and the Union. It is to continue present <br /> practices for this fiscal year because of alleged hardship and then beginning July 1, <br /> 1983, they will have to live with what the contract states. It addresses it for the <br /> • future. The individuals will agree to the document and we will have clemency our first <br /> year. They want to negotiate that. <br /> Bob told the Board of Selectmen that the Personnel Board did not mind giving the exten- <br /> sion but that they wanted 'to make sure that it is coming out in the next contract. He <br /> mentioned how the firefighters were telling the Board that they were going to get it any- <br /> way. <br />
